Separation of Powers Division of government into three branches, each with their own powers and responsibilities. Legislative Branch – Congress Executive Branch – President Judicial Branch – Supreme Court

Make Laws for the U.S. Enforce the Laws Interpret the Laws Congress Separation of Powers   Legislative Executive Judicial Separate Power given to each branch  In the US we call this branch  Make Laws for the U.S. Enforce the Laws Interpret the Laws Congress House & Senate U.S. Courts Supreme Court President Thanks GW

Separation of Powers Separation of Powers is a government principle in which the powers of the government is divided among different branches, each with their own roles and responsibilities . What would cause the framers of the Constitution to establish a system of separation of powers?

Checks and Balances Checks and Balances is the system in which each branch of the government has the ability to limit the powers of the other branches to prevent any from becoming too powerful.

Checks and Balances Vetoing their Bills Override his veto's, Impeach and remove from office, approves Presidential appointments Vetoing their Bills Approves Judicial Appointments, can Impeach Federal Judges Can declare laws Unconstitutional Appoints Federal Judges to the Federal Courts Can declare executive Action Unconstitutional

Courts can declare Legislative acts UNCONSTITUTIONAL. 1- What check does the Supreme Court have over the Legislative Branch? 2- What check does the Supreme Court have over the Executive Branch? 3- Why do you think the founding fathers made the Supreme Court Justice's job for life as opposed to being elected like other government officials? Courts can declare Legislative acts UNCONSTITUTIONAL. Courts can declare Executive actions & orders acts UNCONSTITUTIONAL. So Judges don’t have to worry about running for re-election. It takes the politics out of their decisions.

NOT 1st Amendment political Speech. Tinker v. Des Moines “students [do not] shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.” 1st Amendment Free Speech “materially and substantially disrupt the work and discipline of the [public] school.”   NOT 1st Amendment political Speech.

The Judicial Branch Role: To interpret the law and actions of the government

The Judicial Branch Composed of: The Supreme Court (9 Justices) and gave it power to create lower federal courts - each state also has its own state court system

The Judicial Branch Led by: The Chief Justice of the Supreme Court John Roberts

How do you become a Federal judge Appointed by: The President Approved by: The Senate Term: For Life NO confirmation Hearing for Merrick Garland Until 2016 Presidential Election is over!

Power of the Judicial Branch Power: Judicial Review Established by Marbury v. Madison (1803) Strengthened the Power of Supreme Court Definition: The power to decide whether any law passed by Congress or Presidential Action/order is constitutional or unconstitutional.

Closing Question: How did the Constitution even out the powers of the federal government?
