Combating Drug Abuse in Montenegro “The abuse of drugs and psychoactive substances may harm the rule of law and security of society, inflict suffering both to individuals and their families, and result in the loss of lives.” II. Combating Drug Abuse in Montenegro The Penal Code of Montenegro defines two criminal offenses in regard with drug abuse, which are the following: Article 300: (1) Whoever illegaly produces, processes, sells or offers for sale or buys for sale, holds or transfers, or who mediates in sale or purchase, or otherwise unlawfully puts into circulation substances that have been declared for narcotic drugs or plants containing such substances, shall be punished by imprisonment for two to ten years. Article 301: (1) Whoever instructs another to use narcotic drugs or gives them a narcotic drug to use, or provide them with premises for the purpose of using a narcotic drug, or otherwise allows another to use narcotic drugs, shall be punished by imprisonment from six months to five years.
