GINA Genome Information Non-discrimination Act

What it does Employers cannot hire, fire, promote or require genetic testing of an individual based on genetic information. Health insurers cannot require genetic tests or deny coverage based on such test results.

What it does Defines “genetic test” and “genetic information”.

Pros Individuals can participate in clinical trials/genetic tests without fear of being fired or losing health coverage.

What it DOES NOT do Does not apply to companies of less than 15 employees. Does not overrule state law. Does not protect privacy. Does not cover life insurance. Does not describe punishment for violating GINA.

Cons Coverage for same condition differs based on genetic information. Exceptionalism could increase stigma of genetic conditions, genetic tests, etc. Public does not understand lack of privacy. Lawmakers complacent regarding genetic discrimination.
