Support to and Capitalization on the EU Land Governance Programme 4th Capitalization Meeting Country: Kingdom of Swaziland Name of Project: Enhanced Capacity for Sustainable Land Administration and Management at National, Regional and Chiefdom Level Date: 22 November 2016

Introduction Technical Assistance support to the Government of Swaziland in Sustainable Land Administration and Management Land tenure system in Swaziland is categorized into three; SNL, TDL and Crown land SNL is land vested in the Ingwenyama in trust for the Swazi Nation and is allocated to the Swazis by chiefs. TDL is freehold land registered at deeds office. Crown land is State land.

Introduction The Financing Agreement (FA) of this project was signed on 30 March 2014. The project is managed at the Ministry of Natural Resources and Energy (Surveyor General Office) and the Ministry of Agriculture/ SWADE The MOA/SWADE has the most relevant experience of working with the traditional authorities and communities with regard to chiefdom planning and land matters

Purpose and Result Areas of the Project Overall objective of the project is to contribute to improving tenure security and land access for the rural poor thereby improving food security. Purpose of the project is to: "To provide tools and capacities for sustainable land administration and management at national, regional and chiefdom level". The purpose of the Technical Assistance services contract is to support the implementation of the project. Result Areas Tools for more efficient Land Administration i.e mapping of SNL and and Chiefdom boundaries Capacity building of stakeholders to use the cadastre and manage SNL more efficiently and sustainably through piloting the approach in 4 Tinkhundla Develop Institutional arrangements for land management with specific provision for SNL

Key Outputs Tools are developed and used for more efficient Land Administration and management of SNL at the Constituency and the National level The related structures (Traditional Authorities, and government officials), are capacitated to use the cadastre and manage SNL more efficiently and sustainable

Progress The Project was presented to: Land Management Board Three Principal Secretaries in the implementing ministries Ministers in the implementing ministries A Consultant (COWI) was awarded a contract and they are on the ground setting teams Authorization to continue with the project has been given by three ministers Consultation with Ministry of Tinkhundla and Administration stakeholders is ongoing

Challenges and Lessons Learnt Draft Land Bill was developed, but has not yet been passed on to cabinet. Access to traditional structures require more time Lessons Learnt Multi stakeholder consultation is key and critical in improving governance of tenure Country Land Management Boards (CLMBs) should be in place early on and strengthened in order to avoid susceptibility to questioning structures. It is important to carefully choose pilot areas, particularly, with a view to avoid potential conflicts.
