ROJ-TV A/S and Mesopotamia Broadcast METV A/S Introduction to the case: The case concerned two broadcasting companies, who in the period February 2008 to September 2010, repeatedly sent out TV programmes via ROJ-TV containing interviews with PKK sympathizers and leaders. Furthermore these programmes contained on-the-spot reports from fights between Kurds and Turkish authorities and PKK training camps. Hereby ROJ-TV functioned as a mouthpiece for the PKK by calling for participation in terror actions, encouraging to join the PKK and speaking in a glorifying way about PKKs actions. PKK is listed as a terrorist organisation by the EU. The case contained several international aspects, such as the fact that the TV programmes shown on ROJ-TV were produced in Belgium. During the investigation a coordination meeting was held at Eurojust in June 2009 on Danish initiative, where a total of 7 member states participated. Furthermore letters of request were sent to 6 different member states, on the basis of information on bank transactions, in order to be able to follow the money flow behind ROJ-TV. Two further coordination meetings concerning this case and other PKK related cases in other member states were held in January and June 2012 on the initiative of Italy. 11th of February 2013 by Jesper Hjortenberg - National Member for Denmark

ROJ-TV A/S and Mesopotamia Broadcast METV A/S Outcome: The companies were charged for a violation of article 114e in the Danish Criminal Code for having promoted the work of a group or an association – in this case the PKK/KONGRA-GEL - who commits or intends to commit actions covered by the provisions in the Danish Criminal Code that criminalises terrorism (sections 114, 114a, 114b, 114c and 114d). Both companies were convicted in accordance with the charge were each sentenced to pay 40 day fines – one day fine being stated as 65.000DKK (8.713€). The case is currently under appeal at the Eastern High Court and the verdict is expected during the summer 2013. 11th of February 2013 by Jesper Hjortenberg - National Member for Denmark

Jesper Hjortenberg - National Member for Denmark The PKK funding case Introduction to the case: During the investigation in the ROJ-TV case, a high level of knowledge, of the organisation of and money flow within the PKK, was obtained by Danish police. As a result hereof a new investigation was carried out and it was discovered that extensive financial collections for the PKK are supposed to take place in Denmark. A huge amount of the collected money seems to be channelled through ROJ-TV. Since ROJ-TV must be seen as the mouthpiece of the PKK, according to the verdict mentioned previously, there are clear indications for the fact that the money is made available to the PKK. During the investigation Denmark benefited from the coordination by Eurojust inter alia the meeting in June 2012. Two European arrest warrants were issued in the case. One resulted in the arrest and extradition of a suspect from Germany. Jesper Hjortenberg - National Member for Denmark The PKK funding case Outcome: Apart from the two suspects arrested in Germany and Switzerland, eight persons were arrested in Denmark. Seven of these were held in remand, but have since been released. Tactical meeting on PKK hosted by Eurojust In January 2013 Eurojust hosted a tactical meeting on the PKK, where practitioners from all 27 EU member states and the Eurojust contact point in Turkey, were invited to participate. For the Danish police and prosecution service, this meant that the participants were able to share the general knowledge obtained in the two abovementioned cases and that they were able to obtain further knowledge on similar ongoing cases in other European countries. The meeting also meant that personal contacts could be established or enhanced between practitioners working on cases concerning the PKK and thereby contacts in future investigations are made easier and faster. 11th of February 2013 by Jesper Hjortenberg - National Member for Denmark
