WI Act 185 Implementation Update Wisconsin County Human Services Association Fall Conference November 29, 2018

Stakeholder Input Gathering Early input gathering focused on understanding the basic provisions of the Act; next steps in implementation; questions about the Act; and gathering general input to guide future work. Structured input gathering through stakeholder groups and public meetings using a list of questions. 4 public meetings Over 10 others Over 240 people and at least 32 counties Summaries presented to Juvenile Corrections Study Committee and available on https://doc.wi.gov/Pages/AboutDOC/Act185.aspx (July 25 and August 28 meetings) Outreach and input is ongoing

Juvenile Corrections Study Committee Juvenile Corrections Study Committee (JCSC): Three county representatives (human or social services department) Secretaries or designees of DOC and DCF (co-chairs) Secretary of DHS or designee County with the highest percentage of juveniles under state or county supervision under chapter 938 DPI superintendent or designee State public defender or designee Three assembly representatives and three senators County that operates a regional juvenile detention center that is an eligible juvenile detention facility Two judges, two district attorneys, and two law enforcement One organization focused on eliminating race-based discrimination Another county One resident who has been, or has had a close family member who has been, under the supervision of DOC under Chapter 938 One nonprofit focused on issues relating to juvenile justice One nonprofit focused on best practices for holding juveniles in secure custody One sheriff

Juvenile Corrections Grant Committee Juvenile Corrections Grant Committee (JCGC): Governor or designee Secretaries or designees of DOC and DCF Three assembly representatives and three senators One nonprofit focused on best practices for holding juveniles in secure custody

Juvenile Corrections Grant Committee Juvenile Corrections Grant Committee (JCGC) Establish requirements, guidelines, and criteria for SRCC grants. Review applications (due March 31, 2019). Recommend a statewide plan for approval to the Joint Committee on Finance by July 1, 2019. Oversee the progress of projects funded by the grants.

DOC – Office of Detention Facilities (ODF) Promulgate administrative rule for SRCCs Emergency rule draft due to Governor by December 17, 2018. Permanent rule to be in effect by January 1, 2021.

DOC – Division of Juvenile Corrections (DJC) Prototype design for new Type 1 juvenile correctional facilities. Agency 2019-21 budget request. Agency budget requests available on DOA’s website at: https://doa.wi.gov/Pages/StateFinances/2019-21-Biennial-Budget-Agency-Requests-.aspx Because number, locations, and size of facilities are not yet finalized, budget submission includes staffing needed for a single 32-bed facility (to be scaled up as needed) Includes staff for education and treatment, security, facilities and management, and health services

Department of Health Services (DHS) Mendota Juvenile Treatment Center expansion Agency’s 2019-21 budget request Agency budget requests available on DOA’s website at: https://doa.wi.gov/Pages/StateFinances/2019-21-Biennial-Budget-Agency-Requests-.aspx DHS proposes a 64-bed expansion of MJTC Increases capacity to 93 beds total, including beds for up to 20 female juveniles.

Department of Children and Families (DCF) Partner with DOC on Program and Service requirements for SRCCCY Youth Aids Bonuses State agency responsible for administering Youth Aids funding to counties, and training, data and standards development for the Youth Justice System (except correctional placements)

Review of Selected Key Dates   September 1, 2018 JCSC recommendations for SRCC services and programming to DOC November 1, 2018 JCSC recommendations for Type 1 facility locations to DOC December 31, 2018 Emergency rule for SRCCs in effect March 31, 2019 SRCC grant applications due to JCGC July 1, 2019 JCGC submits plan to Joint Committee on Finance January 1, 2021 Youth transferred from CLS/LHS to new Type 1 facilities and SRCCs
