Employee Classification (a)(1) – A former Gov. officer or employee (a) (2) – A former Gov. officer or employee with supervisory / managerial duties 207 (b) Same as (a) (1) 207 (c) – “Senior” employees
“Senior” Employee Positions specified in or fixed according to 5 U.S.C. 5311-5318, except 5312 Individuals whose rate of basic pay is equal to or greater than 86.5 percent of the rate for level II of the Executive Schedule (less than $164,004 in 2018) O-7 or above active duty commissioned officers
207 Misconception None of the statute’s seven restrictions bar any individual from accepting employment with any private or public employment
207 (a) (1) Lifetime Restriction After you leave Government service, you may not represent someone else to the Government regarding particular matters that you worked on while in Government service.
207 (a) (2) 2 Year Restriction For 2 years after leaving Government service, you may not represent someone else to the Government regarding particular matter that you did not work on yourself, but were pending under your responsibility during your last year of Gov. service.
207 (b) Trade or Treaty Assistance 1 Year Ban For 1 one after leaving Gov. service, you may not aid, advise, or represent someone else regarding trade or treaty negotiations that you worked on during your last year of Gov., service.
207 (c) 1 Year Restriction on Communication with One’s Former Agency For 1 one after leaving Gov. service, you may not aid, advise, or represent someone else regarding trade or treaty negotiations that you worked on during your last year of Gov., service.
203 Prohibited Compensation After you leave Gov. service, you may not accept compensation for representational services, which were provided by anyone while you were a Gov. employee, before a Federal agency regarding particular matters in which the Gov. was a party or had a substantial interest,
Restrictions for Retired military personnel Unless you receive prior authorization from your Service Secretary and the Secretary of State, you may forfeit your military pay during the time you perform services for a foreign government.
