FEDERAL ANTI-DISCRIMINATION STATUTES: INTRODUCTORY DQs (BADLANDS) DQ2.01. U.S.C. §1982 gives all U.S. citizens “the same right” as “white citizens” to own or lease property. Based on your sense of a reasonable interpretation of this statutory language, which of the follow people can sue to enforce §1982? (a) People denied housing because they are Latinos? (b) People denied housing because they are Jewish? (c) People denied housing because they are white? (d) A white person who loses their apartment because they have non- white visitors?

FEDERAL ANTI-DISCRIMINATION STATUTES: INTRODUCTORY DQs (BADLANDS) DQ2.02. The most fundamental provisions of the FHA are §§3604(a) and (f)(1), which prohibit discrimination in the sale or rental of housing. What sorts of people are protected by these provisions?

FEDERAL ANTI-DISCRIMINATION STATUTES: INTRODUCTORY DQs (BADLANDS) DQ2.03. What is discrimination on the basis of “familial status” under the FHA? Why might this be a serious problem? Why is there a special exception for this type of discrimination in §3607(b)? DQ2.04. The FHA prohibits discrimination on the basis of “sex.” In what kinds of situations do you imagine housing discrimination on the basis of sex most commonly occurs?

FEDERAL ANTI-DISCRIMINATION STATUTES: INTRODUCTORY DQs (BADLANDS) DQ2.05. §1982 of the Civil Rights Act of 1866 and §3604(a)-(d) of the FHA both prohibit certain types of discrimination in property transactions on the basis of race. Can you identify racially-based conduct that is prohibited by one statute but not by the other?

DQ2.06: Purposes of FHA Provisions(BADLANDS) (a) 3604(e): It shall be unlawful … (e) For profit, to induce or attempt to induce any person to sell or rent any dwelling by representations regarding the entry or prospective entry into the neighborhood of a person or persons of a particular race, color, religion, sex, handicap, familial status, or national origin. (b) 3604 (f)(3)(A) For purposes of this subsection, discrimination includes— (A) a refusal to permit, at the expense of the handicapped person, reasonable modifications of existing premises occupied or to be occupied by such person if such modifications may be necessary to afford such person full enjoyment of the premises

DQ2.06: Purposes of FHA Provisions(BADLANDS) (d) 3607(a) (a) Religious organizations and private clubs. Nothing in this subchapter shall prohibit a religious organization, association, or society, or any nonprofit institution or organization operated, supervised or controlled by or in conjunction with a religious organization, association, or society, from limiting the sale, rental or occupancy of dwellings which it owns or operates for other than a commercial purpose to persons of the same religion, or from giving preference to such persons, unless membership in such religion is restricted on account of race, color, or national origin.

DQ2.06: Purposes of FHA Provisions(BADLANDS) (d) 3607(a) Religious organizations and private clubs. … Nor shall anything in this subchapter prohibit a private club not in fact open to the public, which as an incident to its primary purpose or purposes provides lodgings which it owns or operates for other than a commercial purpose, from limiting the rental or occupancy of such lodgings to its members or from giving preference to its members.

DQ2.06: Purposes of FHA Provisions(BADLANDS) 3603(b) Exemptions. Nothing in [§3604] (other than subsection (c)) shall apply to— (2) rooms or units in dwellings containing living quarters occupied or intended to be occupied by no more than four families living independently of each other, if the owner actually maintains and occupies one of such living quarters as his residence. …  (1) any single‑family house sold or rented by an owner: Provided, That such private individual owner does not own more than three such single‑family houses at any one time… Provided further, That … the sale or rental of any such single‑family house shall be excepted from the application of this title only if such house is sold or rented (A) without the use in any manner of the sales or rental facilities or the sales or rental services of any real estate broker, agent, or salesman, …
