Did the threat… Cause a reaction of any type by an official authorized to deal w/ emergencies? Place any person or a substantial group of the public in fear of imminent serious bodily injury? Influence the conduct or activities of a political subdivision of the state – e.g. a school district?
Factors to Consider What was the specificity/plausibility of the threat? Did the individual making the threat have the means and/or a viable plan? How were you alerted to the threat? How was it initially communicated? Was it posted to social media? What was the District’s level of response – Were District staff diverted? Was NEPD involved? Are any criminal charges being filed? Was it necessary to conduct a welfare check? What were the results – access to weapons, etc.? Was there a discernible impact on campus operations – i.e. a decline in ADA, an atypical number of students being signed out, multiple concerned parent emails, etc.?
PPS Supports to Campuses Ask clarifying questions to support investigation and principal’s recommendation based on threat classification Ensure consistency across the District for TEA audits, Open Records requests from advocacy groups, OCR inquiries, etc.
Administrator vs. NEPD Officer Responsibilities Is the alleged behavior a violation of the Student Code of Conduct? (You are not investigating the commission of a crime) Do I have a preponderance of evidence that the alleged conduct occurred? (You are not held to a “proof beyond a reasonable doubt” standard) Have I provided the student/parent “due process” to address the allegation? (How campus classifies an incident isn’t dependent upon how/if NEPD chooses to file and vice versa)
