UNC & EU 3rd Package Change of Supplier CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. All rights Reserved.

Overview EU 3rd Package Requirements Current Supplier / Shipper Processes EDF Energy’s position Potential solutions & Impacts Issues & Questions that need to be resolved CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. All rights Reserved.

EU 3rd Package Requirements Article 3 Para. 6: “Member States shall ensure that: where a customer, while respecting the contractual conditions, wishes to change supplier, the change is effected by the operator(s) concerned within three weeks; and…” Requirement for UK Government to be directing implementation by 1 March 2011 CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. All rights Reserved.

Current Supplier/Shipper Processes Contract “signed” with customer 14 day “cooling off period” Statutory requirement: 7 days face to face 14 days distance selling – telephone, internet Supply Point Confirmation Submitted UNC – 15 to 30 business days before registration date (G2.5.8) CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. All rights Reserved.

EDF Energy’s Position The 3 week switching timetable should start after the cooling off period has finished as: Reduces the likelihood of erroneous transfer Improves customer experience Provides an opportunity to ensure required information is present and accurate Limits impact on Shipper and Transporter systems CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. Potential Solutions – Interim until Nexus/Smart Reduce the Supply Point registration date so that it can be 10 business days after the Supply Point Confirmation Reduce the objection deadline to 5 business days Reduce the notifications for confirmation and objection to same day CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. All rights Reserved.

Impacts No/limited impact on cooling off periods Should ensure no detrimental impact to customer experience/satisfaction Suppliers would have 7 calendar days to ensure required information is accurate and available Shippers would have 5 business days to raise and resolve objections – currently up to 9 business days Shippers would be able to withdraw a Supply Point Confirmation up to 5 business days prior to registration Transporters would be required to provide notification within day Aligns gas and electricity objection windows/practices CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. All rights Reserved.

Issues & Questions Impacts on Shipper system & processes limited? Are there any impacts on SPAA? Are the timelines workable for objection notification & resolution? When are confirmations & objections deemed to be received – same business day, or following business day? Xoserve system impacts – what are these and how much will they cost? Issues with cross/duplicate meters Any other issues / solutions? CONFIDENTIAL - Title of presentation © 24 November 2009 EDF Energy plc. All rights Reserved.
