Workshop of the Airport Regions Conference on Regulation 598/2014 Implications of the regulation 598/2014 from the perspective of a regional authority: Hessen, Germany (Frankfurt Airport) Workshop of the Airport Regions Conference on Regulation 598/2014 Regine Barth, Head of Department Aircraft Noise Management Ministry for Economics, Energy, Transport and Regional Development, State of Hessen Brussels, 20 November 2015

Content of the Presentation Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Content of the Presentation Why the Hessian Ministry for Economy and Transport (HMWEVL) had a closer look on the Regulation 598/2014 Brief overview on structures and measures in Frankfurt Analysis of the Regulation from the perspective of the competent authority for Frankfurt Airport 20 November 2015

Reasons to have a closer look Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Reasons to have a closer look Hessian Government intends to implement a noise limit for the Frankfurt Airport to limit noise in the future (Noise limit shall ensure that noise level will be lower than anticipated in 2007 for full enlarged capacity when decision for forth runway was taken) Quite a number of letters from citizens and citizens organisations fearing that Hessen must take back the night flight ban introduced in 2011 in Frankfurt due to the regulation Questions from Parliament on the ratification of the bilateral agreement on aviation EU/USA which contains partly similar stipulations as the Regulation 20 November 2015

State of play in Frankfurt – Stakeholder Dialogue Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Stakeholder Dialogue Voluntary: State of Hessen started to fund and strengthen Stakeholder Dialogue from 2008 Mediation process 1998-2000 Regional Dialogforum 2000-2008 Forum Aiport and Region since 2008 Participants are municipalities, airport, airlines, ATC, public authorities, experts, associations Mandatory: For legal procedures such as implementing new ATC procedures also “Aircraft Noise Commission” mainly municipalities and counties, but all other stakeholders which consults ATC and Authorities 20 November 2015

State of play in Frankfurt – Noise Abatement Procedures Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Noise Abatement Procedures Frankfurt is front runner (international and national) but lacks to communicate that outside Germany Expert Commission installed since 2008, led by Deutsche Flugsicherung (German ATC) and a local mayor; several working groups First Package of Abatement Measures in 2010 (3,2 Degrees landing on new runway, Segmented (curved) RNAV Approach for nighttime, etc.) 20 November 2015

State of play in Frankfurt – Noise Abatement Procedures Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Noise Abatement Procedures Continous development of additional measures (height increase of transitions, avoiding turns on ILS over Offenbach and Mainz, …) Dedicated Runways Operations: New concept in test phase for night flights since April 2014 Fraport and Deutsche Flugsicherung installed GBAS: new types of procedures, e.g. to better avoid settlement areas 20 November 2015

State of play in Frankfurt – Active Noise Abatement Measures Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Active Noise Abatement Measures 2016: RF-Legs Trials Since 2014: Lufthansa, Condor have refitted A-320 familiy with vortex generator - > several dB less noise especially for landings; avoidance of certain tones Working group led by HMWEVL how to amend framework conditions and avoid barriers for active noise abatement measures Next Noise Abatement Package is being worked on, foreseen for 2017 20 November 2015

State of play in Frankfurt – Operations Restrictions Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Operations Restrictions Night Flight Ban was introduced in 2011 (together with the start of operating the new runway) No scheduled flights from 23:00-5:00 local time Maximum of 133 scheduled flights from 22:00 – 6:00 local time (average per night / year) Exceptions for landings: Possible until 0:00 local time, but not more than average of 7,5 per night / year Exceptions for take-offs: Only possible if the reason for delay could not be influenced by airline, needs prior permission by HMWEVL Exceptions for special cases (Medical, safety etc.) Only Chapter 4 Aircraft 20 November 2015

State of play in Frankfurt – Land Use Management Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Land Use Management Since around 2000 a large zone has been defined where no new zoning for housing is allowed (legally binding; implemented in regional land use plans) 2011: Implementation of Noise Protection Area according to the national Noise Protection Act: No new housing allowed; restrictions for hospitals, schools etc. Insulation of houses and appartments; Fraport has to fund measures Additionally: “Regional Fund” installed by Hessian Government to additionally provide help for citizens severely affected by noise 20 November 2015

State of play in Frankfurt – Noise Related Fees Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Noise Related Fees Fraport has been frontrunner Continuous increase of noise related share and of incentive for less noisy aircraft Next Innovation foreseen in 2016: Incentive for GBAS installment 20 November 2015

The regulation 598/14 from HMWEVL perspective Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung The regulation 598/14 from HMWEVL perspective Mainly procedural requirements Most aspects already covered by German Administrative Law and German Aviation Law Administrative Burden: Must use a different method of noise calculation (Doc ECAC 29) 20 November 2015

The ICAO Balanced Approach as main requirement of Reg. 598/14 Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung The ICAO Balanced Approach as main requirement of Reg. 598/14 EU-Regulation 598/2014 reinforces the ICAO “balanced approach” regarding the implementation of noise-related operating restrictions. No novelty: EU Member states = members of ICAO Directive 2002/30/EC already referred to the “balanced approach” 20 November 2015

Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Regulation No 598/2014 does not prevent Member States to implement noise abatement measures. However, it introduces a set of procedural rules which the Member States have to comply with when considering noise abatement measures, especially operating restrictions. 20 November 2015

What is the so called “balanced approach“? Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung What is the so called “balanced approach“? First introduced in Assembly Resolution A 33-7 (2001) Resolution A35-5 (2004) Resolution A36-22 (2007); principles on environmental protection Annex 16 to the Treaty of Chicago (Vol. I Part V) More detailed: Guidance on the Balanced Approach to Aircraft Noise Management, Doc 9829 (2008) 20 November 2015

Definition in Annex 16 to the Treaty of Chicago: Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Definition in Annex 16 to the Treaty of Chicago: The balanced approach to noise management consists of identifying the noise problem at an airport and then analysing the various measures available to reduce noise through the exploration of four principal elements, namely reduction at source, land-use planning and management, noise abatement operational procedures and operating restrictions, with the goal of addressing the noise problem in the most cost-effective manner. 20 November 2015

Member States’ competences are not reduced: ICAO recognizes, that Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Member States’ competences are not reduced: ICAO recognizes, that responsibility for development of appropriate solutions lies with the individual State (with due regard to ICAO rules and policies). airport-by-airport approach is necessary: Solutions need to be tailored to the specifics of each airport. 20 November 2015

States may have wider policies on noise management. Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung national legal frameworks may affect the implementation of the “balanced approach”. States may have wider policies on noise management. Implementation of the “balanced approach” differs from state to state. 20 November 2015

Principle of proportionality: Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Germany has a very similar, legally binding rational in administrative law which covers the requirments of the balcanced Approach: Principle of proportionality: State may not affect the rights of a person or company without adhering to this principle: - measure must be able to sucessfully address the problem which shall be solved measure must be the mildest interference with existing rights to reach the solution of the problem if several options exist Measure must be proportionate 20 November 2015

Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung ICAO’s standards and instruments are not the sole measures for States to resolve conflicts on the subject of aircraft noise (e.g. operational restrictions at Frankfurt Airport) We will be able to implement the Regulation 598 with some additional administrative burden, but no limitation regarding the content of possible operations restrictions if we adhere to the principle of proportionality Donnerstag, 4. April 2019

Thank you for your attention! Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Thank you for your attention! 20 November 2015
