Constitution Articles, Sections and Paragraphs 11/18/14 Test date on Tuesday

Starting with 5. 3 – 1Q: “We the People means Starting with 5.3 – 1Q: “We the People means?” and which goal is the most important. A: All Americans. Back in 1787, only white society.

2Q: Article 1, Section 2 A: House of Representative members must be 25 years old, a citizen for 7 years and elected to a 2 year term. Terms that are so often could lead to costly campaigns and 2 years isn’t a long time to understand the job yet.

3Q: Article 1, Section 3? A: Senators must be 30 years old, a citizen for 9 years and up for re-election every 6 years.

4Q: Article 1, Section 3, paragraph 6 & 7. A: The Chief Justice of the Supreme Court will preside over the impeachment trial. No person shall be convicted without 2/3rds of the members present. The House of Representatives brings the charges forward and the Senate acts as jury. Impeachment means – kick out of office.

5Q: Article 1, Section 6 describes A: Payment and privileges of congress members. At the time the text was written, Congress members made $136,700 (14 years ago) Today it’s $174,000.

6Q: Article 1, Section 7 describe how a bill becomes a law. A: chart on pg. 252 in your text. President can approve or veto the bill. Then it becomes either a law or Congress will need to approve it with a 2/3rds majority vote.

7Q: Article 1, Section 8 lists Congressional Powers A:Name a power and back up why you think it is an important power for Congress to have.

9Q:Article 1, Section 8, Paragraph 18 – The Elastic Clause is important because… A: The Elastic Clause to allow Congress to make any law necessary in order to carry out its delegated powers.

9Q: Article 1, Section 9 Habeas corpus ensures justice. A: By protecting people from being jailed indefinitely without a trial. Habeas Corpus – Latin for you have the body (or prisoner) in question.

10Q: Article 1, Section 9 Titles of Nobility A: Framers disapproved of titles of nobility such as “King, Queen, or Duke.”

11Q: Article 2, Section 1 The president must be 35 years at the time he is elected. Every 4 years, the president is up for re-election. Only two 4 year terms can be served. And he/she must be a natural born citizen.

12Q: Electoral College pg 12Q: Electoral College pg. 256 – There are a total of 538 electoral votes. A: California has the most at 55, The least is 3 and there are several states in the Midwest and elsewhere with this number. Reason for an Electoral College: 1) Because of the lack of flowing information the framers wanted to place a check on the uneducated. And 2) Small states would have a larger voice as well.

13Q:Presidential salary and benefits. A: $400,000 + $50,000 in non tax expense account. Air force 1, Camp David Vacation Spot, White House living are all benefits.

14 Q: Who is next in line? A: The Vice President – Joe Biden, followed by Speaker of the House, President Pro-Tempore of the Senate, followed by members of the presidential cabinet: Secretary of State, Secretary of Treasury.

15Q:Justices hold their offices for… A: life. They die or retire. Current Chief Justice is John G. Roberts, Jr.

16Q:Why is Judicial Review an important action? A: The Supreme Court has the power to declare a law unconstitutional.

17Q: Discuss what checks and balances are and why are they important? A: No single branch overpowers the other. They keep each other in check.

18Q: Dividing power between the state and federal gov’t is called? A: Federalism. Used in order to build cooperation between the national and state gov’t

19Q: Article 4, Section 2 A: Article 4 is about honoring each states laws, records and court rulings. An example is extradition, which is turning over a criminal to the state where the crime occurred.

20Q: How do you amend the Constitution? A: 2/3rds of both houses must vote to deem it necessary.

21Q: Article 6 What happens when you have a huge national debt? A: Cuts in Federal Programs, borrow from other countries, deflates the value of our money.

22Q: Article 6, Section 2 Supremacy Clause or Supreme Law of the land means state law cannot contradict federal law. Example: Federal troops were sent into the state of Arkansas when that state failed to let African American students into all white schools.

23Q: Article 7 A: If Women, Native Americans and African Americans had a voice, then there would be no slavery, women would have the right to vote and Indians would have the right to keep their lands instead of being thrown onto reservations and thus dying in the trail of tears.
