Atuação Responsável ® Um compromisso da Indústria Química GLOBAL THEMATIC WORKSHOP ON STRENGTHENING CAPACITIES TO IMPLEMENT THE GHS The Role of the Brazilian Industry in GHS Implementation Marcelo Kos Director, Technical Affairs, Brazilian Chemical Industry Association - ABIQUIM Johannesburg, South Africa 16 November 2005

Atuação Responsável ® Um compromisso da Indústria Química The Brazilian Chemical Industry Association ABIQUIM Founded in 1964, represents 142 chemical companies, responsible for more than 85% of chemicals production in Brazil, and 31 Responsible Care Partner companies.

Atuação Responsável ® Um compromisso da Indústria Química

Atuação Responsável ® Um compromisso da Indústria Química Contents I. Situation & Gap Analysis II. Actions Required III. Conclusions Conclusions

Atuação Responsável ® Um compromisso da Indústria Química Situation Analysis 1.What is the structure and size of the chemical industry in the country? 2.What knowledge and capacities exist concerning how to classify chemicals and mixtures? Where are these capacities located? 3.What criteria are used by companies undertaking classification? 4.What knowledge and capacity exist concerning how to prepare SDSs and labels? What label and SDS formats are in use? 5.What awareness raising and training activities are undertaken by chemical companies who produce and sell chemicals and those who use them? 6.Which other initiatives have been taken through companies or industry associations related to chemical hazard communication? 7.What resources are available to deliver the activities identified?

Atuação Responsável ® Um compromisso da Indústria Química Situation: What is the structure and size of the chemical industry in the country?

Atuação Responsável ® Um compromisso da Indústria Química Brazilian Chemical Industry Net Sales – 2004 Total: US$ 60,8 billion Source: ABIQUIM and sectoral trade associations Ethanol not included (US$ 6 billion)

Atuação Responsável ® Um compromisso da Indústria Química BAHIA RIO DE JANEIRO SÃO PAULO RIO GRANDE DO SUL BRASIL ALAGOAS and SERGIPE MINAS GERAIS AMAZONAS ESPÍRITO SANTO SANTA CATARINA PARANÁ States where member companies facilities are located. PERNAMBUCO GOIÁS R. GRANDE DO NORTE Chemical Facilities in Brazil

Atuação Responsável ® Um compromisso da Indústria Química = Number of industrial chemicals production sites listed in the Brazilian Chemical Industry Guide. 771 = Number of industrial chemicals producing companies listed in the Brazilian Chemical Industry Guide. The Brazilian Chemical Industry 321 = Number of ABIQUIMs members production sites = Number of chemicals producing companies according to the Brazilian Statistics Institute (IBGE).

Atuação Responsável ® Um compromisso da Indústria Química = Number of industrial chemicals listed in the Brazilian Chemical Industry Guide (about 550 produced by member companies). The Brazilian Chemicals Market (?) = Number of all chemical substances in the market (industrial, paints, dyes, soaps and detergents, agro chemicals, fertilizers, etc.) (?) = Number of all chemical mixtures in the market (industrial, paints, dyes, soaps and detergents, agro chemicals, fertilizers, etc.)

Atuação Responsável ® Um compromisso da Indústria Química Situation: What knowledge and capacities exist concerning how to classify chemicals and mixtures? Where are these capacities located? Most big companies (national or multinational), most medium size companies producing dangerous mixtures and a very small number of small companies have the knowledge to classify chemicals and mixtures. A limited number have the capacity to perform testing.

Atuação Responsável ® Um compromisso da Indústria Química Gap: Is there sufficient knowledge and capacity in industry concerning how to classify chemicals and mixtures according to the GHS? No, they should be extended to all medium and small sized companies that produce chemicals (specialties in particular) and mixtures.

Atuação Responsável ® Um compromisso da Indústria Química Situation: What criteria are used by companies undertaking classification? There are criteria to classify agrochemicals (FAO and WHO) and dangerous products for transport (UN).

Atuação Responsável ® Um compromisso da Indústria Química Situation: What knowledge and capacity exist concerning how to prepare SDSs and labels? What label and SDS formats are in use? Most big companies (national or multinational), most medium size companies producing dangerous mixtures and a very small number of small companies have the knowledge to prepare SDSs and labels for chemicals and mixtures. Formats: Labelling: different labels, no single standard (under preparation) Safety Data Sheets: national standard based on ISO 11014

Atuação Responsável ® Um compromisso da Indústria Química ABIQUIM hosts the Brazilian Standardization Committee on Chemistry - CB-10/ABNT - SDS standard (NBR 14725/2001); - Hazard Classification Criteria for Chemicals and Testing Methods (under development since 2001); - Hazard Communication Labelling for Chemicals (under development since 2001)

Atuação Responsável ® Um compromisso da Indústria Química Gap: Is sufficient capacity in place to prepare SDSs and labels? No, there is a strong need to develop capacity in small and medium sized companies.

Safety Data Sheets for Chemicals Produced or Marketed by ABIQUIMs Member Companies Better MSDS/Chemical (%)

Atuação Responsável ® Um compromisso da Indústria Química Situation: What awareness raising and training activities are undertaken by chemical companies who produce and sell chemicals and those who use them? Situation: What awareness raising and training activities are undertaken by chemical companies who produce and sell chemicals and those who use them? ABIQUIM has not yet listed the types of activities undertaken by its member companies and of the industry as a hole. However, we know that many companies regularly train their workers, distributors, transporters and customers on how to handle their products.

Atuação Responsável ® Um compromisso da Indústria Química Situation: Which other initiatives have been taken through companies or industry associations related to chemical hazard communication?

Atuação Responsável ® Um compromisso da Indústria Química ABIQUIMs Initiatives Position Paper: Recommendation for GHS Implementation - (2002); Publication: The Globally Harmonized System – a summary (2003); Publication: Listing of Tests for substances and mixtures classification – (2004); Survey: Industry capacity for chemicals testing – (2004/2005); Survey: Laboratories capacity for chemicals testing – (2004/2005); Guide: What is the GHS? – (2005)

Atuação Responsável ® Um compromisso da Indústria Química Gap: Does industry and trade implement sufficient complementary activities to facilitate effective chemical hazard communication? (e.g. training of workers) Very difficult to say, there are no indicators that can provide quantitative measures for the entire industry.

Atuação Responsável ® Um compromisso da Indústria Química Effective Chemical Hazard Communication There are 3 basic needs to allow effective communication on chemical hazards : 1.The need to update and harmonize existing voluntary standards and regulations according to GHS, considering the different users – i.e. workers, transportation; 2.The need to create voluntary standards and regulations according to GHS criteria, regarding classification of substances and mixtures; 3.The need to create voluntary standards and regulations for labelling.

Atuação Responsável ® Um compromisso da Indústria Química Gap: To what extent do affected business and trade entities effectively implement chemical hazard communication programmes? Are there any groups that require particular attention? There is a strong need to outreach other industry sectors in the country that also produce chemicals or mixtures and also, smaller chemical companies that are not ABIQUIMs members.

Atuação Responsável ® Um compromisso da Indústria Química Companies provide the resources... Situation: What resources are available to deliver the activities identified?

Atuação Responsável ® Um compromisso da Indústria Química Actions Required: Hazard Classification Create national voluntary standards on criteria, methods and testing;Create national voluntary standards on criteria, methods and testing; Get the acceptance of existing international data, testing and information;Get the acceptance of existing international data, testing and information; Develop partnerships with international chemical databases.Develop partnerships with international chemical databases.

Atuação Responsável ® Um compromisso da Indústria Química Identification: Inventory - Define a list of priority industrial chemicals produced or marketed in Brazil; Identify and accept existing information for industrial chemicals; Classify, according to GHS criteria and end-points those industrial chemicals; Define a schedule for identification and classification. Apply laboratories tests, if there is no data available. Actions Required: Hazard Classification

Atuação Responsável ® Um compromisso da Indústria Química SDSs Revise and harmonize the contents of existing SDSs, if necessary; Create SDSs for substances and mixtures not previously classified; Labelling Develop the standards and regulations in accordance with the GHS; Revise existing labels; Create labels for substances and mistures not previously classified. Actions Required: Hazard Communication

Atuação Responsável ® Um compromisso da Indústria Química Publish GHS guide for downstream users; Train more professionals from ABIQUIM member companies, as well as non members and other industry sectors; Qualify industry, laboratory firms and universities to perform testing; Develop databases in Portuguese. Actions Required: Capacity Building

Atuação Responsável ® Um compromisso da Indústria Química Conclusions 1.There is a long way ahead and the Brazilian industry needs to get more involved with the implementation of the GHS; 2.Regulation and/or voluntary standards must be in place if the GHS is to become a reality in Brazil; 3.Capacity and knowledge within the different industry sectors are needed in other to allow effective hazard classification and communication; 4.The 2008 target is difficult to meet, but industry will implememnt the GHS having in mind the need to keep its competitiveness in the international trade arena.

Atuação Responsável ® Um compromisso da Indústria Química Thank you!
