Scenario #1 By Jennifer Posch

Which Law is being Violated? The law in the first scenario that is being broken is The HIPPA Privacy Rule This Rule is set in place for ones privacy over their medical records. It also sets in place regulations as to how an individuals information is passed from one doctor to the next. The law was being violated do to the nature of the individual having access to their next door neighbors medical records.

Article or legal case The legal case can be due to if the medical claims processor speaks with the neighbor of family members. The information of said neighbor is his and his alone it should not be spreading to other people as they do not need to know

Solution A solution for this scenario can be, once the claims processor see the name of the individual, they should immediately call on their supervisor to say I can not work on this case, due to him being my neighbor.

Scenario #2 Jennifer Posch

What law is being violated? The law that is being violated is the affirmative action law It is being violated because the coworker believes that due to him NOT being African American or Latino

Legal case under the violation The legal case that is under this violation is that even those he passed with flying colors, it shows that the university chose other people based on their ethnicity. It can show that the university does not care about the grade rather than it having different ethnicities. A violation can happen for the co worker as well do to him looking through the files, even though its his job, they may say its an issue because you looked it up for your own gain.

Solution The coworker should take his evidence to the affirmative action board and see what they do. They university may say well why did you look at the results, but he has the right grade and the ability to get in.

Scenario 3 Jennifer Posch

What law is being violated? The law that is being broken is The civil right act of 1964 It’s a law that prohibited in a job on the basis of sex, race, color, national origin and religion. It is a federal law, but state and local laws can be added.

Legal case? The legal case in the situation is She is being sexually harassed She has told people to stop and they haven’t She has gone t o multiple people including coworkers, supervisor and even the HR manager with no results.

Ethical Solution? An ethical solution that can prevent the violation are A line in the employment contract stating if this were to occur this is what needs to be done. What to done if the business is not helping Who's next on the list to talk to Unfortunately if it happens write down, what when and where from the attacks and who you talked to about it. Have employees take mandatory training Make sure they know that it’s a federal offence and what can happen if its done
