GENERAL PRINCIPLES Equitable and Reasonable Utilization and Participation The parties shall participate in the use, development and protection of the River Wide Basin in an equitable and reasonable manner and in the interest of all parties. Such participation includes both the right to utilize the watercourse and the duty to cooperate in the protection and development thereof, as provided in the present Agreement. 2. Factors Relevant to Equitable and Reasonable Utilization The parties undertake to observe the following factors: Geographic, hydrographic, hydrological, climatic, ecological and other factors of a natural character; The social and economic needs of the Parties; (c) The population dependent on the watercourse in each Party; (d) The effects of the use or uses of the watercourses in one watercourse Party on other watercourse Parties;

(e) Existing and potential uses of the watercourse; (f) Conservation, protection, development and economy of use of the water resources of the watercourse and the costs of measures taken to that effect; (g) The availability of alternatives, of comparable value, to a particular planned or existing use. Obligation Not to Cause Significant Harm Each Party shall take all appropriate measures to prevent the causing of significant harm to other watercourse States. General Obligation to Cooperate Each Party shall cooperate on the basis of sovereign equality, territorial integrity, mutual benefit and good faith in order to attain optimal utilization and adequate protection of the River Wide Basin. There shall be established a joint commission to facilitate cooperation on relevant measures and implementation of this agreement. 5. Regular Exchange of Data and Information Parties shall on a regular basis exchange readily available data and information on the condition of the watercourse, in particular that of a hydrological, meteorological, hydrogeological and ecological nature and related to the water quality as well as related forecasts.

6. Sovereignty of aquifer states Each party has a sovereignty over the portion of trans boundary aquifer or aquifer system located within its territory. It shall exercise its sovereignty in accordance with international law and the present agreement.
