IEEE-SA Patent Policy Monday: Open plenary January 2010 Jon Rosdahl, CSR

Participants, Patents, and Duty to Inform January 2010 doc.: IEEE 802.11-10/0076r0 January 2010 Participants, Patents, and Duty to Inform All participants in this meeting have certain obligations under the IEEE-SA Patent Policy. Participants: “Shall inform the IEEE (or cause the IEEE to be informed)” of the identity of each “holder of any potential Essential Patent Claims of which they are personally aware” if the claims are owned or controlled by the participant or the entity the participant is from, employed by, or otherwise represents “Personal awareness” means that the participant “is personally aware that the holder may have a potential Essential Patent Claim,” even if the participant is not personally aware of the specific patents or patent claims “Should inform the IEEE (or cause the IEEE to be informed)” of the identity of “any other holders of such potential Essential Patent Claims” (that is, third parties that are not affiliated with the participant, with the participant’s employer, or with anyone else that the participant is from or otherwise represents) The above does not apply if the patent claim is already the subject of an Accepted Letter of Assurance that applies to the proposed standard(s) under consideration by this group Quoted text excerpted from IEEE-SA Standards Board Bylaws subclause 6.2 Early identification of holders of potential Essential Patent Claims is strongly encouraged No duty to perform a patent search Slide #1 Jon Rosdahl, CSR Jon Rosdahl, CSR

Call for Potentially Essential Patents January 2010 If anyone in this meeting is personally aware of the holder of any patent claims that are potentially essential to implementation of the proposed standard(s) under consideration by this group and that are not already the subject of an Accepted Letter of Assurance: Either speak up now or Provide the chair of this group with the identity of the holder(s) of any and all such claims as soon as possible or Cause an LOA to be submitted Slide #3 Jon Rosdahl, CSR

Other Guidelines for IEEE WG Meetings January 2010 doc.: IEEE 802.11-10/0076r0 January 2010 Other Guidelines for IEEE WG Meetings All IEEE-SA standards meetings shall be conducted in compliance with all applicable laws, including antitrust and competition laws. Don’t discuss the interpretation, validity, or essentiality of patents/patent claims. Don’t discuss specific license rates, terms, or conditions. Relative costs, including licensing costs of essential patent claims, of different technical approaches may be discussed in standards development meetings. Technical considerations remain primary focus Don’t discuss or engage in the fixing of product prices, allocation of customers, or division of sales markets. Don’t discuss the status or substance of ongoing or threatened litigation. Don’t be silent if inappropriate topics are discussed … do formally object. --------------------------------------------------------------- See IEEE-SA Standards Board Operations Manual, clause 5.3.10 and “Promoting Competition and Innovation: What You Need to Know about the IEEE Standards Association's Antitrust and Competition Policy” for more details. Status of 802.11 Operation Manual (OM) January 2010 Status of 802.11 Operation Manual (OM) 802 WG P&P 802.11 WG P&P 802.11 WG OM Starting with the 802.11 WG P&P Divided into the 802 WG P&P and 802.11 WG OM Jon Rosdahl, CSR

Value of 802.11 WG Operation Manual January 2010 Value of 802.11 WG Operation Manual The 802.11 WG OM is not an exhaustive list of rules. The 802.11 WG OM is actually a summary of normal operating guidelines which the WG group operates. The OM describes the Hierarchy of the set of precedent rules that we are obligated to operate under. (i.e 802 WG P&P, IEEE-SA rules, Computer Society rules etc.). Describes tasks and common logistics Describes the voting rights and attendance guidelines Describes how groups are formed and operated. Mid-week Plenary (Wednesday) January 2010 Mid-week Plenary (Wednesday) Registration Processes Jon Rosdahl, CSR

Why Register Early? Individual Discounts for registering Early January 2010 Why Register Early? Individual Discounts for registering Early WG able to control Costs Increased cost for last minute changes: Meeting space F&B AV – Power – Projectors - Screens Penalties for Missing a room block We watch the block very closely. Hotels do not allow Early booking without room block commitments. Significant penalties for not getting room-nights. Leadership works to find savings and pass them on to the group. Jon Rosdahl, CSR

Why do we have Room-block requirements? January 2010 Why do we have Room-block requirements? In order to schedule a Hotel venue more than 90 days in advance, you must provide a guarantee of how many people will attend. For this venue, without a room-block commitment: Room Rental: $400,000 F&B Minimum: $150,000 Approx Cost per person if we had 450 attendees = $1200 (does not include additional charges for AV, Internet, Power, etc). Meeting our commitment is critical: Substantial fees for not meeting commitment (e.g. pay the missing nights charges plus a penalty) Jon Rosdahl, CSR

How can I help and reduce my costs? January 2010 How can I help and reduce my costs? Register Early Stay in the hotel venue Register for hotel early Any problem with getting hotel contact the meeting planners Don’t waste food Enjoy “A” cookie Don’t waste bandwidth Do updates and non-IEEE file transfers at home. Jon Rosdahl, CSR
