Background Moved stormwater session laws into EMC’s 02H rules over past few years SL 2006-246 (Phase II) SL 2008-211 (Coastal stormwater) At end of process SL 2011-220 passed Change to SL 2006-246

The Change SL 2006-246 - whole counties subject to Phase II SW based on county growth rate (“tipped” county) SL 2011-220 modified that growth rate criteria Requires us to likewise modify any rules adopted Result - one county dropped out of county-wide Phase II SW (“un-tipped” county) Implementing SL 2011-220 since June 23, 2011
