ARTICLE I LEGISLATIVE BRANCH SS.7.C.3.3 – ILLUSTRATE THE STRUCTURE AND FUNCTION (THREE BRANCHES OF GOVERNMENT ESTABLISHED IN ARTICLES I, II, AND III WITH CORRESPONDING POWERS) OF GOVERNMENT IN THE UNITED STATES AS ESTABLISHED IN THE CONSTITUTION.

BICAMERAL

BICAMERAL ARTICLE I – SECTION 1 – REQUIRES CONGRESS TO BE A BICAMERAL SYSTEM: A. HOUSE OF REPRESENTATIVES B. SENATE **THIS WAS A COMPROMISE BETWEEN THE POWER OF THE STATES AND THE POWER OF THE PEOPLE.

REPRESENTATION IN CONGRESS ARTICLE 1 – SECTION 1 HOUSE OF REPRESENTATIVES = representation for each state (number of representatives sent to Congress) is based on the population of the state. Compromise from the Virginia Plan. A. 435 members of the H. of Representatives B. # of representatives shift as the population of each state shifts depending upon census.

SENATE ARTICLE 1 – SECTION 1 SENATE = 2 Senators per state. Equal among all states. A. 100 members in the Senate B. Elected every 6 years. C. Compromise with smaller states – New Jersey Plan.

HOUSE OF REPRESENTATIVES ARTICLE 1 – SECTION 2 QUALIFICATIONS: A. 25 years of age. B. Citizen of United States for 7 years. C. Residency in the state in which they are elected to represent. Terms In Office – 2 year terms in office. CENSUS – REQUIRED EVERY 10 YEARS TO DETERMINE THE # OF REPRESENTATIVES PER STATE.

HOUSE OF REPRESENTATIVES ARTICLE 1 – SECTION 2 OPERATING RULES FOR THE HOUSE OF REPRESENTATIVES. SPEAKER OF THE HOUSE – ELECTED BY THE MEMBERS – 3RD IN LINE TO THE PRESIDENCY. IMPEACHMENT – CAN CHARGE AND REMOVE A PRESIDENT FOR HIGH CRIMES – THE TRIAL IS HELD IN THE SENATE.

SENATE ARTICLE 1 – SECTION 3 QUALIFICATIONS: A. 30 YEARS OLD B. CITIZEN OF THE U.S. FOR 9 YEARS C. RESIDENCY IN THE STATE THEY REPRESENT. TERMS IN OFFICE: 6 YEAR TERMS WITH NO LIMITS ONE/THIRD OF SENATORS UP FOR RE-ELECTION EVERY TWO YEARS.

SENATE VICE-PRESIDENT IS THE PRESIDENT OF THE SENATE. DOES NOT HAVE A VOTE UNLESS THERE IS A TIE VOTE. PRESIDENT PRO TEMPORE – PRESIDES OVER THE SENATE WHEN THE VP IS NOT PRESENT.

“ELASTIC CLAUSE” THE POWERS OF CONGRESS ARE LIMITED TO THOSE LISTED, OR ENUMERATED, AND THOSE THAT ARE “NECESSARY AND PROPER” OR “IMPLIED” TO CARRY THEM OUT. ALL OTHER LAWMAKING POWERS ARE LEFT OR DELEGATED TO THE STATES.
