Deficiencies Unapproved and outdated materials being used. Outdated regulations, missing NYS regulations, etc. Not all required topics/subtopics being taught. Incomplete agendas, agendas not reflective of actual class instruction, etc. Hands-on not following 12 NYCRR Part 56 requirements and procedures. General safety procedures not being followed during hands-on. Improper notification, cancelations and timely submission of certs and accompanying payments.
Notification/Cancellation of courses 10 NYCRR, Part 73.2(h) 2 weeks in advance (no roster needed) Less 2 weeks, but at least 72 hours prior (roster needed) Less than 72 hours not allowed (unless “environmental emergency”) Cancellation - no later than 10:00 a.m. on the first day of course For off-site training: location, phone number, dimensions of both the classroom, and hands-on areas with total available space. DOL vs DOH expiration dates NYSDOH - Asbestos safety training requirements - 10 NYCRR, Part 73 NYSDOH training certificates (DOH-2832) are valid for one calendar year Individuals working on asbestos projects should have a valid (non-expired) training certificate If not actively working, cannot exceed 2 years between training courses (Federal grace period) NYSDOL - Asbestos certification requirements - 12 NYCRR, Part 56 NYSDOL asbestos handler certifications (hardcards) expire at the end of the birth month Sometimes less and sometimes more than a year from when you obtain/renew a hardcard Hardcard expiration date does not coincide with the expiration date of the DOH-2832 cert NYSDOL expects individuals to train annually, even though hardcards do not always expire annually (Otherwise risk being required to “double-up” on refresher courses) Recommendation All instructors should remind trainees to complete refresher training annually before their DOH-2832 training certificate expires. Trainees should do this regardless of when their NYSDOL hardcard expires. This is specified in the Student Information Memo that each trainee is required to sign at the beginning of each training course.
