What is an Ignition Interlock? Referred to as BAIID, IID or Interlock - a device that interrupts the ignition of a vehicle, ultimately preventing the vehicle from starting Similar to a breathalyzer or PBT that is utilized to determine a person’s breathe alcohol content, or BrAC level

What is the Purpose of an Ignition Interlock? The IID’s objective is to determine whether or not the user providing the test contains alcohol in their system and if the sample is below a set-point. If so, then the vehicle is allowed to start.

EMPLOYMENT EXEMPTION The Employment Exemption Affidavit allows an individual who holds an ignition interlock license to drive an employer-owned vehicle not equipped with ignition interlock for work purposes only. The Employment Exemption Affidavit cannot be used: • to drive a school bus, school vehicle, or a vehicle designed to transport more than 15 passengers; • if the employer-owned motor vehicle is owned by an entity which is wholly or partially owned by the person holding the ignition interlock license. • if the employer-owned vehicle is made available to the employee for personal use. • by certified inspection mechanics to test drive customer vehicles. The Employment Exemption Affidavit must be completed in its entirety and be in the driver’s possession while operating an employer-owned vehicle not equipped with ignition interlock. If driver does not have a completed Employment Exemption Affidavit in their possession they can be cited for driving without an ignition interlock.

Clients no longer surrender their license in court Client is convicted or enters ARD Court sends conviction or ARD paperwork to PennDOT PennDOT will issue a Notification of Suspension Letter Includes instructions on surrendering license Lists DATE that license will go suspended (60 Days) Section 1540 (relating to surrender of license) requires the court or district attorney to inform the defendant, when convicted of an offense with a suspension of operating privilege, that their suspension will be effective within 60 days.

Interlock is an “option” for ARD Interlock is an option, but not required Notification of Suspension Letter from PennDOT Ignition Interlock Limited License Petition & Process Section 1556 (relating to ignition interlock limited license) allows an individual whose license has been suspended under §3870(d) (relating to accelerated rehabilitative disposition) to be eligible, but not required, to apply for and be issued an ignition interlock limited license.

Petitioning for Ignition Interlock Limited License: PennDOT is notified of Conviction or ARD participation PennDOT will mail a NOTIFICATION OF SUSPENSION letter to client Once “Notification of Suspension” letter is received, client can call an Interlock Vendor to set up an installation appointment when eligible (see charts) Client will need to fill out the DL-9108 Client will take the DL-9108SC (page 4) to Installation Appointment Interlock Installation process is completed Vendor’s PennDOT approved person verifies Interlock is installed, signs the DL-9108SC and email/mail back to client Client sends the completed DL-9108, DL-9108SC, other required forms & fees (see checklist) to PennDOT by CERTIFIED MAIL

Client Experience

INTERLOCK INSTALLATION Client has someone with a valid license drive them to the Service Center (same person will drive home) Client brings in all required documents Client signs a lease, pays for installation and first month's lease fee Client is trained on how interlock works and how to complete a test Client is reminded that they cannot drive the interlock equipped vehicle until he/she is issued the Ignition Interlock Limited License or Restricted Interlock License

Monthly Service Process First service MUST take place 30 days after Interlock is installed After the 1st service, the client will need to return to the service center every 30 to 60 days to have their Interlock serviced Service on average takes approximately 10 - 15 minutes Service includes download of the devices data, calibration of the Interlock unit and payment of the lease Data recorded by the Interlock device goes through processing and generates a data report which is sent into PennDOT

What Causes a Violation? Ignoring a rolling test – displayed as a “Missed Test” Providing a sample on an initial or rolling test that is not a pass -displayed as a “FAIL” or “VIOL” Bypassing the device by starting your vehicle without providing a passing test - displayed as a “START VIOL” Disconnecting the handset unit from the curly cord while the engine is on

PennDOT’s Regulations: Violation Lockout (Early Recall) Interlock pre-set with allowable number of violations based on state regulations: 3 Initial test violations 1 running retest violation 1 running retest skip 1 event of tampering 1 illegal start violation 90% full data logger memory Any one or a combination of the above violations will result in the Interlock unit going into “early recall” and needing to get the unit RESET at the Service Location.

DECLARATION OF COMPLIANCE End of Interlock Program ARD Clients - The following incidents have not occurred in the prior 30 days Non-ARD Clients – The following incidents have not occurred in the prior 60 days ____ 1. An attempt to start the vehicle with a breath alcohol concentration of 0.08% or more, not followed within 10 minutes by a subsequent attempt with a breath alcohol concentration lower than 0.08%. ____ 2. Failure to take or pass any required retest. ____ 3. Failure of the driver to appear at the ignition interlock system vendor when required for maintenance, repair, calibration, monitoring, inspection or replacement of the device such that the ignition interlock system no longer functions as required under subsection (h).
