Chapter 15, Section 3 The American Legal System

Main Idea: The Constitution and American legal system offer protections to the citizens of the United States, including those accused of crimes!

1. Legislative Branch- Make Laws I. Legal Protections in the U.S. Constitution A. The Constitution gives each branch of government a role in shaping laws. 1. Legislative Branch- Make Laws 2. Executive Branch- Enforce Laws 3. Judicial Branch- Interpret Laws

***Courts base rulings on precedents. This process is called stare decisis*** B. Stare Decisis- “Let the Decision Stand”

***We are all protected by powers listed in the Constitution*** C. Cannot be kept in jail unlawfully D. Writ of Habeas Corpus- Accused must appear in court to explain why they are being held.

E. Bill of attainder-laws that punish a person for a crime without a trial or fair hearing in court. F. Ex post facto law- punishing a person for an action that was not against the law when it was committed.

G Fifth and Fourteenth amendments guarantee due process of law- the government may not take our basic freedoms without following established legal procedures.

H. Fourteenth Amendment: 1. Equal protection clause- requires government to treat all people equally regardless of gender, race, religion
