Summary: 38th JSTC Meeting Sep 15 & 17, 2010 Kobe, Japan Semiconductor Industry Association in Japan 1

1. MCP/MCO Semiconductor Industry Association in Europe reported on the September 8 meeting of customs experts on the subject of multi-component products (MCOs). Later in the afternoon, Semiconductor Industry Association in Europe presented the results of the discussion in the breakout session. After discussion, JSTC approved the revised presentation on MCOs for use in the informal GAMS session on MCOs in the afternoon. After the informal GAMS meeting, JSTC reviewed the MCO presentation to the GAMS and approved it with slight modifications. The JSTC took note of the concerns expressed by Semiconductor Industry Association in China in regard to the points raised by the Chinese GAMS representative on the MCO issue.

2. Effective Protection of Intellectual Property As Task Force Chair, Semiconductor Industry Association in Japan presented a report to the JSTC on the work of the IP Task Force. Some associations expressed concern over the wording of the NPE slide. The IP TF informed the JSTC that members had agreed that all associations would obtain as much detailed feedback as possible on the patent quality chart and send this to Chinese Taipei by 15 December 2010. Semiconductor Industry Association in Chinese Taipei presented a draft letter to WIPO, which was revised in response to some suggestions and subsequently approved by the JSTC and signed by the JSTC Chairs. Semiconductor Industry Association in Europe noted that some associations had followed up on anti-counterfeiting, and stressed that it was very important that all do so to the greatest extent possible. Semiconductor Industry Association in China, the preceding IP Task Force chair, then presented to JSTC the draft presentation to GAMS. After discussion and some modifications, including removal of the NPE slide and a correction to the title of the presentation, JSTC approved the WSC report to GAMS on Effective Protection of Intellectual Property. 3

3. Cooperative Approaches in Protecting the Global Environment -1 As Task Force Chair, Semiconductor Industry Association in Japan presented to the JSTC the ESH Task Force report for approval along with the presentation to GAMS. Semiconductor Industry Association in Europe requested that a fuller explanation be included of the significant variation in water and electricity data for 2009 and that a summary of the 2009 PFOS data be added. The ESH Task Force Chair revised the relevant slides accordingly, and the presentation was approved. Semiconductor Industry Association in Japan, as Task Force Chair, reported on the results of the ESH Task Force Meeting to the JSTC. An additional meeting was held in the afternoon of September 16 to further discuss the activities of the Task Force. 4

3. Cooperative Approaches in Protecting the Global Environment -2 It was noted that the ESH Task Force has an open action to provide an updated rationale for changing from an absolute value to an NER target for the post-2010 PFC reduction program. With respect to PFC, it was confirmed that the Task Force would create best practice guidelines by February 2011. Semiconductor Industry Association in Europe pointed out that because absolute values are easier for the public to understand. The semiconductor industry needs to be prepared to explain the rationale behind the shift to NER in a manner that can be easily understood by a general audience. Therefore, adopting best practices is a critical component of the post-2010 program. It was agreed that the PFC post-2010 NER emission reduction targets and the rationale for changing from absolute value to NER, would be reported to the JSTC in February 2011. With respect to the quantitative target for water, some associations expressed their concern that the TF decision to remove water from the WSC quantitative target list could impact negatively on the public image of the industry, and urged that each association seek to discuss the potential impact of this decision at the top management level of member companies. The JSTC agreed to report the results of that discussion in the February 2011 meeting. 5

4. Market Task Force Report Semiconductor Industry Association in Korea introduced the Market Task Force Report and the draft presentation to GAMS. The report looked at issues such as market growth areas and market conditions by region, suggesting that the market outlook for semiconductors is improving. The results of the DRAM cycle analysis were also reported. The JSTC approved the presentation with slight modifications. 5. Social Contribution & Green IT Semiconductor Industry Association in Japan introduced the Outreach Task Force report to be presented to the GAMS. The JSTC asked that the presentation be revised to emphasize the important social contribution provided by semiconductors. Semiconductor Industry Association in Japan made these changes, and JSTC approved the revised presentation. Semiconductor Industry Association in Japan raised the issue of the Outreach Task Force chairmanship, suggesting that the country chairing the WSC should also chair the Outreach Task Force. The JSTC agreed that given that Semiconductor Industry Association in Japan would continue chairing the Task Force until May 2011, the matter would be decided at the next JSTC meeting. 6

6. Export/Import Regulatory Restrictions Semiconductor Industry Association in China then gave a presentation by reviewing the WSC Statement and Action Item in May 2010 and providing some findings from Semiconductor Industry Association in China on export restriction and impacts to semiconductor industry. Having recognized the goal mandated by the WSC statement, the participants conducted a discussion to decide the next steps. The participants agreed that the first step is to define the possible scope of the work. The suggestion was made that it may be productive and efficient to include existing cases and, based on these existing cases and the suggested scope, each association will help to provide an overview of export/import restrictions. 7. Encryption Certification and Licensing Regulations Semiconductor Industry Association in Europe sought approval from the JSTC for the draft presentation to GAMS, comprising the WSC best practice statement and recommendations to GAMS. The JSTC approved the presentation. 7

8. Regional Stimulus 9. WSC 2.0 Task Force Report Semiconductor Industry Association in US presented a brief summary of the breakout session’s discussion on the memory bailout issue that concluded that the JSTC or a working group should carry on the discussion. The draft presentation to GAMS, which focused on the recommendations to GAMS, was approved by the JSTC. 9. WSC 2.0 Task Force Report As the WSC 2.0 Task Force Chair, Semiconductor Industry Association in Japan presented a report on discussion at the TF meeting. With respect to streamlining presentations, it was agreed that associations would examine the idea of combining the Joint Statement and the GAMS Recommendations into one document for the GAMS and report back to the next TF meeting in Shanghai. With respect to managing the number of TFs and WGs, the Task Force will endeavor to make a proposal to be discussed at the JSTC as to the possibility of determining the continuation of Task Forces and Working Groups at February JSTC meetings. 8
