NLHSG Breakfast Meeting 2017 18th May 2017 The Morning from Hell This workshop style session considers a fatal accident at work and the various things that may happen thereafter. As the incident unfolds, you will be presented with a series of events and asked to consider your response or “advice to the board”. The subject matter includes police powers, HSE inspector powers, requests for personal information, whistleblowing, various interviews by the regulators, dealing with Trade Unions and legal privilege. The aims of the workshop are to: Familiarise you with the powers of the police and HSE when investigating a workplace accident. Familiarise you with the Work Related Deaths Protocol. Introduce you to some common issues which arise during investigations and how these may be resolved. The importance of legal privilege. The importance of having a policy which governs incident response. You can have as much or as little involvement in this workshop as you wish. Hopefully, we will be able to dispel some myths about accident investigation and share experiences as a group The session will conclude with a short legal update looking at recent developments in the world of health and safety. Speaker Profile Kirsty Gomersal This session is led by Kirsty Gomersal, a partner with DAC Beachcroft and based in Leeds. Kirsty has over 20 years' experience of advising on investigations into health and safety and environmental incidents. She is an experienced advocate and regularly represents organisations and individuals in prosecutions by the HSE, EA and local authorities. Kirsty is also one of HM Assistant Coroners for West Yorkshire (West).
