Situation INSPIRE data not, or not yet available, in all 28 MS Alternative data sources are being used (since there is a need for pan-European datasets) Investment in INSPIRE is not valorised and implementation gaps are apparent ----> There is a common interest between Commission and Member States to overcome this situation
COM Regulation 268/2010 Sets out harmonised conditions for access EU institutions can request access MS have to provide access to data within 20 days (Art. 7) or give reasons for the restriction to access (Art. 2 based on Art 17.7 INSPIRE)
Practical arrangements Informal request from DG ENV to INSPIRE NCP (aim to solve issue without formal request) Formal request from COM to PermRep (will include formal deadline) – basis for enforcement Access to spatial data should be organised through the INSPIRE Geoportal Do we need further guidelines / templates?
Next steps First requests will be issued soon Focus on priority datasets and other key datasets as identified by Commission services (e.g. Copernicus) A successful cooperation will also be a showcase on the benefits and added value of the INSPIRE Directive
