Goals for the Draft Regulations To meet Federal requirements to protect the economic assets that are the airports. To encourage aviation-compatible land uses. To allow for differences between airports. To protect existing neighborhoods. To set the appropriate level of regulation in both detail and scope. Houston Airport Commission

Draft Regulations Most of the existing airport regulations are in Chapter 9, Aviation, of the City Code. HAS proposes a new Article VI, Airport Land Use Regulations, in Chapter 9. Relationships with other jurisdictions: Statute allows the city to regulate land use in the ETJ and, by interlocal agreement, with other cities. Houston Airport Commission

Creation of Three Tiers Tier 1 – Primarily based on future noise contours, including 65 DNL extended to property line boundaries Tier 2 – Followed natural boundaries (i.e. streets, bayous, etc.) Tier 3 – Predefined by state law (3 x 5 mile box) Houston Airport Commission

Compatible Land Use Regulations Division II—IAH specific regulations Division III—HOU specific regulations Division IV—EFD specific regulations Each division specifies what land uses are allowed in each tier. Allows city to tailor the regulations to specific conditions or issues by each airport. Specifies conditions to be met, e.g., sound insulation. Houston Airport Commission

Process Initial meetings begun in early May. Public comment draft July 17, 2008. Airport Commission and Council must follow a statutory public hearing process. Community and stakeholder meetings ongoing. Houston Airport Commission

Process Airport Commission will hold at least two public hearings. After close of public hearings, make a final report and recommendation to Council on the regulations and maps. Council will hold at least one public hearing and consider regulations and maps. Houston Airport Commission

Actions Needed Today Motion to make a preliminary report accepting the delivery of the draft regulations and maps. (This motion does not mean that the Airport Commission agrees with or approves the content.) Motion to set the first public hearing. August 21st at the George R. Brown Convention Center; we have it from 2:30 to 7:00 pm Houston Airport Commission
