Articles of Confederation vs. the Constitution

Levying Taxes Articles Constitution Congress could request states to pay taxes Problem = no one will pay government cannot not run without money Congress has right to levy taxes on individuals + government now has money to operate - what if government taxes us to much?

Federal Courts Articles Constitution No system of Federal courts Problem – no one to check other court decisions/solve issue between states Court system created to deal with issues between citizens and states + Checks/Balances, separation of powers - What if all judges all come from area/group

Regulation of trade Articles Constitution No provision to regulate interstate trade Problem - cheap British goods flooding market, states taxing each other Congress has right to regulate trade between states + protect American businesses - goods are now more expensive

Executive Articles Constitution No executive with power. President of US merely presided over Congress Problem – no separation of power/checks Executive branch headed by President who chooses cabinets and has checks on power of judiciary and legislative + checks/balances - President takes power from other branches

Amending Documents Articles Constitution 13/13 needed to amend articles Problem – no amendments get passed to address issue of AOC 2/3 of both houses of Congress plus ¾ of state legislatures or national convention + can fix problems with constitution - still takes lots of effort to bring a change

Representation of States Articles Constitution Each state received one vote Problem – larger states as much say as smaller states (Factions) Upper House (Senate) with 2 votes; Lower House (House of Reps) based on population + more peoples voices are heard - majority groups can take control (factions)

Raising an Army Articles Constitution Congress could not draft troops, dependent on states Problem – cannot defend our self or stop rebellion Congress can raise an army to deal with military situations + can call an army to defend ourselves - what if gov use army against own people

Disputes between states Articles Constitution Complicated system of arbitration Problem – no federal courts to oversee things, states could start fights with each other Federal court system to handle disputes + Checks/balances - what if judges come from one state/group

Sovereignty Articles Constitution Sovereignty resides in states Problem – Fed gov has no power to enforce powers to get job done Constitution that supreme law of the land + Fed gov can enforce its powers - Fed gov abuse states/ its powers

Passing Laws Articles Constitution 9/13 needed to approve legislation Problem – no legislation will get passed to address issues of AOC 50 % + 1 of both houses plus signature of President + can pass laws to address needs - laws might come at expense of minority groups

Legislation Articles Constitution Unicameral Problem – no separation of powers/checks, not enough representation Bicameral + Checks/balances, more representation - longer to get bills passed
