International Law and International Relations 5/28/2019

International Law and International Relations International law defines the rule and principles that are applicable to a large number of states. On the basis of either customary international law or multilateral treaties, they become binding upon all states, the are often referred to as universal international law. 5/28/2019

But there is also regional international law which applies only to certain groups of states such as for example certain rules on diplomatic asylum recognized only by south American States, moreover the term particular international law is used to denote rules, which are binding upon two or few states only. Regionalism tends to undermine the universality of international law but it is an important existing feature of the international system. 5/28/2019

The role of international law in international relations has always been limited but it is rarely insignificant. Its functions in structuring the international system has been enhanced because of increasing global independence and self-interest of state in regulating their intercourse rationally on the basis of reciprocity. Therefore disputes between state are usually accompanied by – in a given case naturally conflicting reference to international law 5/28/2019

A system of law designed primarily for the external relations state does not work like any internal legal system of a state, so there is no reason to assume that the international legal system must or should follow the historical models of centralized systems of national law,. 5/28/2019

for the conduct of states based on international obligation, states are required to perform their international obligation in a good faith. They are free to decide how best to translate their international obligation in to internal law and to determine which legal status these have domestically 5/28/2019
