THE CONSUMER PROTECTION ACT,1986

WHO IS CONSUMER??? Buys any product. Uses a product with the approval of its buyer. Hires any service. Such a person as above is called a ‘consumer’. It must be noted that the size of the product or the amount of money paid for the purchase is irrelevant. So, a consumer case can be filed in connection with purchase of a pen as well as for purchase of a penthouse. The consumer law specifically excludes certain persons from the definition of ‘consumer’.

Obtains goods or services for free. The benefits of this law are not available to any person who: Obtains goods or services for free. Obtains goods or services for the purpose of resale. Obtains goods or services for the purpose of trading.

Right to Safety The consumer should be protected against the marketing of goods or the provision of services that are hazardous to health and life. Right to Information The consumer should be protected against dishonest or misleading advertising or labeling and has the right to be given the facts and information needed to make an informed choice. Right to Choose The consumer has the right to choose from among various products at competitive prices with an assurance of satisfactory quality. Right to Heard The right to express consumer interests in the making and execution of government policies.

Right to Redress The right to be compensated for misrepresentation, shoddy goods or unsatisfactory services. Right to Consumer Education It is the right to acquire knowledge and skills necessary to be an informed customer. Right to a Healthy Environment The right to live and work in an environment which is neither threatening nor dangerous and which permits a life of dignity and well-being. The Right to Satisfaction of Basic Needs Citizens must demand access to essential goods and services such as adequate food, clothing, shelter, health care, education, public utilities, water, and sanitation.

RESPONSIBILITIES The Responsibility to be aware of the quality and safety of goods and services before purchasing. The Responsibility to gather all the information and facts available about a product or service as well as to keep abreast of changes and innovations in the marketplace. The Responsibility to Think Independently and make choices about well considered needs and wants. The Responsibility to Speak Out, to inform manufacturers and governments of needs and wants. The Responsibility to Complain and inform business and other consumers of dissatisfaction with a product or service in a fair and honest manner. The Responsibility to be an Ethical Consumer and to be fair by not engaging in dishonest practices which cost all consumers money. The Responsibility to Respect the Environment and avoid waste, littering and contribution to pollution.

A consumer case can be filed in any of the following cases: the goods suffer from any defect. the services suffer from any deficiency. It naturally means that a consumer case can be filed only if the goods and services are faulty or if the method of selling the goods and services is wrong.

By Non-Advocates or Voluntary Organisations (NGO’s). A complaint containing the required particulars shall be presented by the complainant in person or by his advocate or By Non-Advocates or Voluntary Organisations (NGO’s).

The name, description and the address of the complainant; The name, description and address of the opposite party or parties, as the case may be, so far as they can be ascertained; the facts relating to the complaint and when and where it arose; Documents in support of the allegations contained in the complaint; The relief which the complainant claims.
