Common Terms VOSB Vs. SDVOSB

The “Rule of Two” General: At least two reasonable offers will be made Contract can be awarded at ‘fair market price’

The “Rule of Two” Per 38 USCA § 8127, contract bids shall be restricted to VOSBs when: At least two VOSB/SDVOSB will submit offers Offers will be made at fair and reasonable market price

Business Requirements To be considered an SDVOSB: Business must be ‘small’ according to the SBA A veteran must own 51% of the business The owning veteran must have a service related disability The veteran must control management/daily operation The veteran must hold the highest officer position (CEO)

Federal Government's Responsibilities The Federal Government MUST award a total of 3% of all contracts to a SDVOSB Must ensure that SDVOSB contracts cannot exceed: $5 million for manufacturing requirements $3 million for all other requirements
