about the cruel murder Murder in a cruel way, as well as murder in an insidious manner, are more-qualified killings that are incriminated. These forms of murder have features common to every murder, but are accompanied by a qualitative circumstance that is reflected in the execution mode and can be performed both with direct and with any imagination. For the existence of murder in a cruel way it is necessary to achieve objective and subjective elements. Objective element is filled with the application of severe, excessive pain to the murdered, which would result in the result and duration of a frame of regular suffering that each person will face in the process of deprivation of life. The subjective element consists in such behavior by the perpetrator that it indicates to a greater extent his insensitivity, corruption and desire to enjoy the pain and suffering of the victim, in the nature of personality, his insensitivity and ruthlessness.

In order to make the difference between the ordinary murder of murder in a cruel way it is necessary to appreciate the deprivation of life objectively, the weight of the caused pain, suffering and pain, and the subjective insensitivity of the perpetrator, his desire to give the victim trouble, and the feeling of satisfaction with such a way of deprivation of life.
