FUNCTIONING OF THE BOARDS The Boards are part of the Office. There exists “a continuity in terms of their functions between the Board of Appeal and the examiner”. What are the Boards? They are not a Court. However, they work like a Court! IMPORTANT! Members are independent (Art. 166 (7) EUTMR). Members are not bound by any instructions, but only by the law (Art. 166 (7) EUTMR).

REFERRAL TO THE GRAND BOARD – Art. 37 EUTMDR Reasons for referral to the Grand Board Legal difficulties. Importance of the case. Diverging case law. By the competent Board, or By the Presidium on proposal: of the President of the BoA, of a member of the Presidium. By the Executive Director on points of law, particularly where the BoAs have diverging relevant case law. Not by the parties or another Board. The view of the ED on legal interpretations may be sought. Interested commercial and consumer groups can submit observations on cases submitted.

REGISTRY Responsible for receipt, dispatch, safekeeping and notification of documents in the BoA proceedings. Compilation of appeal files for rapporteurs. Monitoring deadlines and other formal appeal requirements (e.g. submission of the notice and of statement of grounds). Allocation of files among Boards in accordance with Presidium criteria.

KNOWLEDGE, INFORMATION & SUPPORT SERVICE (KISS) The Knowledge, Information and Support Service set up by the President’s decision ADM-14-34 of 2 October 2014. Its tasks include: Quality, Performance and Risk Management; Proof-reading; KC Appeal Processes; Administrative Support; Information Technology (IT); Publications concerning the activities of the Boards of Appeal; Legal advice to Registry; Events & visits.

The Appeal procedure

COMPOSITION OF THE BOARDS Decisions taken by 3 members: The general case (Art. 39 EUTMDR) Decisions taken by single member (Art. 36 EUTMDR): Lack of difficulty in legal or factual subject-matter, absence of special circumstances; Board decides if case is referred to single member. Grand Board Decisions (Art. 157(2) EUTMR)

DECISIONS SUBJECT TO AN APPEAL Trade Mark Matters (Art. 66 and 159 EUTMR): Final decisions of: the Examiners: Filing date (incl. priorities); formalities; AG for refusal; the Opposition Division: Admissibility and allowability of an opposition; the Cancellation Division: Application for revocation; application for a declaration of invalidity; the Department in charge of the Register (including recordals in the EU Trade Mark Register and list of professional representatives). Design Matters: the Invalidity Division: Admissibility and allowability of invalidation proceedings; the Administration of Designs and Legal Division: Recordals in the EU Trade Mark Register and list of professional representatives.

Any party to proceedings adversely affected by a decision: WHO IS ENTITLED TO APPEAL? Any party to proceedings adversely affected by a decision: Art. 67 EUTMR. Who is adversely affected?: Party not prevailing with its claims (but not including): Alternative grounds that are not examined; Unexamined matters affecting conversion rights.

FORM OF APPEAL & TIME LIMIT (Art. 68 EUTMR) Appeal must be written. Notice of Appeal (NoA) within two months after notification of contested decision. Shall be deemed to have been filed only when the fee for an appeal has been paid within the above mentioned period. Statement of Grounds (SoG) within four months after notification of contested decision. Cross Appeal (Art. 68 (2) EUTMR) The other party to inter partes proceedings may seek in its submissions in defense a decision annulling or altering the contested decision on a point not raised in the appeal.

BOA DECISION Art. 71 EUTMR Decision on the appeal: Decision on the admissibility and the substance of the appeal; Option to continue proceedings exercising any power within the competence of the department which was responsible for the decision appealed; If appropriate, remit the case to that department, which is bound by the decision’s ratio decidendi for further prosecution. Decision on costs.

ORAL PROCEEDINGS (Art. 96 EUTMR); Art. 49-55 EUTMDR Only 2 in 14 years. Boards are not against them, but difficult to find files that are appropriate for oral proceedings. Most files are sufficiently complete to enable decision. Could be useful to explore evidential issues (e.g. internet evidence of generic nature of a sign). 2 convoked by 4th Board but both times parties settled.

MEDIATION (Art. 47(4), 64(4), 151(3) and 170 EUTMR) Available for admissible appeals at BoA level in inter partes TM and Design cases . Free of charge in Alicante; EUR 750 admin fee in Brussels. Initiated by: Joint request from parties; Unilateral request forwarded by the Boards to the other party for acceptance; Invitation from the rapporteur to the parties to consider mediation. Appeal proceedings are suspended pending the mediation outcome. Possibility of co-mediators. Significant time and cost savings. Possible outcomes: Settlement agreement (transfer, withdrawal or limitation; co-existence ; joint venture); No agreement and ressumption of appeal proceedings. Confidentiality guaranteed.
