General Overview - What/When/Why - Levels of Right of Way Certification - Methods of Project Delivery - Local Agency R/W Certifications - Local Agency Certification Exhibits

What is Right of Way Certification? Written statement that summarizes the status of all right of way related matters pertaining to a proposed construction project (PS&E). Documentation that the construction package is ready for advertising Certifies that real property interests have been or are being secured; physical obstructions have been (or will be) removed, relocated, or protected as required for construction, operation and maintenance; acquisitions and RAP were conducted in accordance with applicable state/federal laws and procedures.

When is a R/W Certification required? All projects except emergency re-opening of transportation facilities that do not require a PS&E package require a R/W Certification including: Any highway project benefiting from either federal funds or state funds requiring CTC allocation approval Projects with no R/W requirements Projects with only utility involvements (even city owned) Acquisition parcels (either permanent or temporary) including railroad

Why is a R/W Certification necessary? R/W Certification is required per Code of Federal Regulations R/W Certifications are essential for project delivery. Certification is R/W’s main deliverable Cannot advertise without R/W Certification R/W Certification is a mechanism to ensure compliance with federal and state regulations. Federal funds cannot be authorized without the R/W Certification.

R/W Certification Levels Full legal (title) and physical possession of all right of way Can advertise and award Certification 2 – similar to Cert. No. 1 except: Right to occupy and use remaining parcels is by virtue of a Possession and Use Agreement, permit, license, or an approved R/W Contract with effective possession date and funds must be on deposit in an escrow account

R/W Certification Levels (cont’d) “Conditional” Certification 3 Do not have legal possession or right of occupancy on one or more remaining parcels; however, there is a realistic date certain of when control will be obtained. At minimum, parcels not yet acquired must have been adopted by the California Transportation Commission (CTC) with a resolution of necessity (RON). Relocation Assistance & replacement housing has been made available to impacted persons/businesses Utility Relocations and/or Railroad deliverables not yet completed Justification Memorandum to HQ’s must be submitted with the R/W Certification as to why a Conditional R/W Certification 3 is needed. Can advertise but cannot award until R/W Certification is elevated (upgraded) to a R/W Certification 1 or 2 (minimum of 15 working days prior to bid opening).

R/W Certification Levels (cont’d) Certification 3 with Work-Around An agreement has been reached with owner, or a RON has been obtained, but, no physical possession until a later date. Orders for Possession may have been issued and/or served but are not yet effective. Only to be used in extraordinary circumstances; HQ’s Memorandum of justification is required. Can advertise and award (bid package must identify work-arounds) Certification allows for advertisement and physical construction to commence by working around occupants remaining within the right of way. Must be updated 15 days prior to bid opening Cert. 3 & Cert. 3 with work-around must be approved by HQ and, if required FHWA per the Stewardship & Oversight Agreement)

Methods of Project Delivery (cont’d) Design Build Design and construction phases of a project are combined into one contract and approved for construction Accelerates project delivery by allowing design and construction teams to work together early-on to improve constructability DB’s can transfer risk to either the DB contractor (design & construction) or to Caltrans/Local Agency (acquiring r/w) Allows phased delivery of R/W deliverables before and during construction Construction Manager/General Contractor (CM/GC) Two phase contracting method (RFP~Design~Construction) CM is hired as a consultant for project design and may be hired to complete construction as GC.

Methods of Project Delivery (cont’d) DB and CM/GC R/W Certification Process Submittal of a Right of Way Statement that will provide status of all right of way activities Can certify segments of a project as release for construction packages are approved R/W Certifications will meet the requirements for a Cert. 1 or 2 (any deviations from a Cert 1 or 2 will require FHWA approval) Presently, DB and CM/GC Certifications require Caltrans HQ’s approval

Local Agency R/W Certifications Local Agency prepares Right of Way Certification on federally assisted projects for both on-system and off-system projects A Right of Way Certification is completed even if no right of way is required for the project. When property rights are required for local federal-aid project, the agency to certify rights acquired in conformance with Uniform Act. It is crucial that Local Agencies adhere to CFR’s, Caltrans R/W & Local Assistance Manuals so federal funds are not jeopardized. Local Agency R/W Cert.’s are reviewed and accepted by Caltrans R/W Cert. 3’s require acceptance by Caltrans and approval by FHWA
