Birth Registration and Identity Document Legislative Framework Birth and Death Registration Act , 1992 (Act No. 51 of 1992) as amended Regulations on the Registration of Birth and Deaths , 2014 Children’s Act, 2005 (Act No. 38 of 2005) Identification Act, 1997 (Act No. 68 of 1997) as amended Immigration Act, 2002 (Act No. 13 of 2002) as amended Refugees Act, 1998 (Act No. 130 of 1998)

Stipulations on Birth Registrations and Identity Documents Birth registration is the first point of entry into the National Population Register (NPR) with the allocation of a 13-digit unique identity number By law a child must be registered within 30 days from the date of birth (Section 9 of the Act) Any birth registered after 30 days is known as a Late Registration of Birth (LRB) A child must always be present when the birth is registered ( the department is on the verge of biometric enrollment of children to secure identity) Obtain written consent from the parent to register birth if the informant is other than the parent Citizens 16 years and above who qualifies may apply for a South African identity document Recognized Refugees in terms of Section 24 can also apply for Refugee Identity Documents

Birth Registration Requirements : Children born from South African Citizens and Age Categories Age: 0 to 30 Days Parent (s) identity documents Marriage certificate (if applicable) Proof of birth from hospital (DHA-24/PB) Age: 31 days to 1 Year (LRB) Approved by Office Manager Age: 1 Year to 7 Year (LRB) Supporting documents (i.e. Proof of birth from hospital, maternity certificate, letter from school) Supporting documents must be verified prior to adjudication Adjudicated by District committee (Chaired by District Manager Operations) Turnaround times: 180 Days Age: 7 Years and above (LRB) Marriage certificate (where applicable) Two photographs of the child Fingerprints of child to be taken Adjudicated by Provincial committee (Chaired by Provincial Manager)

Birth Registration: Children born from South African Citizens and Foreign Nationals In addition to the above category, the following requirements will apply for children born from South African Citizens and Foreign Nationals: Foreign Nationals must have a valid passport and visa or permit, which must be verified by the immigration section in terms of the Immigration Act, 2002 (Act No. 13 of 2002) as amended Paternity test results not older than 3 months must be obtained from an approved National Health Laboratory Services (NHLS) paternity testing laboratories

Birth Registration Requirements : Abandoned or orphaned children In terms of the Regulations informing the Registration of Births and Deaths, 2014 section 9 (1): Notice of birth of an abandoned or orphaned child must be given by a social worker within 60 days of obtaining a court order in terms of section 156 of the Children’s Act, 2005 (Act No. 38 of 2005), and must be accompanied by the following: “ (a) a court order issued by the children’s court; (b) a certified copy of the identity document or a valid passport and visa or permit of the social worker; (c) where available, a certified copy of the identity document of passport and visa or permit of the parents of the child; (d) where available, a certified copy of the death certificate of the parents of the child; and (e) a social workers’ report that was presented to the children’s court “

Birth Registration: Designated offices for adjudication of Late Registration of Birth (LRB) The following 11 dedicated offices in the province have been identified for late registration of birth adjudication: Beaufort West Bellville Caledon Cape Town George Khayelitsha Malmesbury Paarl Stellenbosch Vredendal Worcester

Identity Document Requirements First Time Issuance Birth Certificate of the child ID book/Smart ID card of the (parent/Informant/Guardian) Child must be accompanied by a parent Proof of residence (where it is available) or provide residential address. No payment required. First Time Issuance when Both Parents are Deceased Death Certificate of the late parent Child must be accompanied by the (Informant/Guardian) The guardian must be in possession of the Legal Documents (Court order, Foster care order) NO Affidavit Online verification report of the (Informant/Guardian) must be attached with supporting documents Proof of residence (where it is available) or provide residential address

Identity Document Requirements Elderly 60 Years and Above Green Bar-Coded Identity Document / Affidavit in case the Green Identity Document is lost Proof of residence (where it is available) or provide residential address Marriage certificate if married (Marriage Verification Status) Divorce decree if divorced (Divorce Verification Status) No Payment Required. Other Citizens Green Bar-Coded Identity Document / Affidavit in case the identity document is lost A fee of R140-00 will be required.
