Overview

Friday morning, 8 a.m. Phil is lifting weights. Shea is checking email. Jen is sleeping. Kyle is eating breakfast.

Phil Is lifting weights. Walked on to the football team yesterday. Remembered to get a preseason physical. Remembered to fill out compliance forms. Remembered to tweet about making the team. Forgot to enroll in classes.

Shea Is checking email. Does not read her university’s emails very often. Showed up for her 8 a.m. dance class today, but the studio was empty. Missed an email from the registrar’s office earlier in the week informing her the class was canceled due to low enrollment.

Jen Is sleeping. Is having a weird dream about zoo animals playing softball. Accidentally set her alarm for 7:45 p.m. instead of 7:45 a.m. Is missing her 8 a.m. anthropology class.

Kyle Is eating breakfast. Is wearing his favorite “NCAA University Swimming” T-shirt. Is enjoying a bagel, coffee and orange juice. Tried to pay for his breakfast, but the manager informed him that the NCAA University swimmers eat free today.

Step 1: Determine whether a violation occurred. Phil practiced while not enrolled. Kyle received a free breakfast based on his athletics reputation. Jen slept through class. Step 1: Determine whether a violation occurred. What about Shea?

Fact-Finding: Shea Initially enrolled in 12 credit hours this semester. Received a class cancelation email from the registrar Monday. Did not read the email until this morning. Had no idea she dropped below full time. Practiced three times this week while enrolled part time. Competed in a match at Rival U. while enrolled part time.

Friday morning, 10:30 a.m. Phil, Shea, and Kyle have all been involved in violations. Who needs to be reinstated? Phil; Shea; Kyle; Phil; Shea and Kyle. No one.

Step 2: Determine whether violation affects eligibility. De minimis violations do not affect eligibility. [D] Restitution violations do not affect eligibility IF the value of benefit is $200 or less AND the SA repays the value of the benefit to charity. [R] All other violations affect eligibility and require reinstatement. Step 2: Determine whether violation affects eligibility.

Phil’s Forgetfulness Phil practiced while not enrolled. NCAA Bylaw 14.1.8.1 violation. Does Phil need to be reinstated? Institutional violation must be reported to the NCAA enforcement staff.

Kyle’s Free Breakfast Kyle received a meal based on his athletics reputation. Violation of Bylaw 12.1.1. Does Kyle need to be reinstated? What else do you need to know?

Kyle’s Free Breakfast Kyle had breakfast at Breadbasket Café. Based on their online menu, the value of his breakfast was $7.92. Kyle is ineligible from the time the NCAA University has knowledge of his receipt of the impermissible benefit until he repays it. Kyle’s eligibility is restored when he pays $7.92 to a charity of his choice. Institution violation must be reported and documentation of repayment forwarded to enforcement staff.

Shea’s Canceled Class Shea practiced, traveled and competed while enrolled part time. Two violations: Bylaw 14.1.8.1 and Bylaw 16.8.1.2. Does Shea need to be reinstated?

Friday afternoon, 12:34 p.m. Phil is enrolled full time. Shea is adding a class to her schedule and is in tonight’s starting lineup. Jen is finally awake. Kyle donated $7.92 to Special Olympics and emailed you the receipt.

Step 3: Declare the student-athlete ineligible and request reinstatement.

IMPORTANT: The RSRO case is not submitted to the NCAA student-athlete reinstatement staff until all required signatures are complete.

Friday afternoon, 2:33 p.m. Shea’s reinstatement request has been submitted and assigned to a NCAA student-athlete reinstatement staff member. What happens next?
