Utah Activities Update New Division Director Ty Howard Legislation House Bill – Radioactive Waste Amendments NRC – IMPEP This September Clive Facility Low-Level Radioactive Waste 11e.(2) Byproduct Mixed Waste Depleted Uranium

2019 Utah Legislation – Radioactive Waste Amendments House Bill 220 – Commercial Waste Fee Amendments Modifies provisions relating to the disposal of radioactive waste: Provides that certain waste classifications are determined at the time of acceptance. Allows the director of the Division of Waste Management and Radiation Control to authorize alternate requirements for waste classification and characteristics that allow an entity to accept certain waste at a specific site. Such as allowing waste greater than Class A if, based on disposal method, the dose does not exceed Class A limits.

2019 Utah Legislation – Radioactive Waste Amendments House Bill 220 – continued Directs the director to require certain actions related to concentrated depleted uranium, such as. Require an approved performance assessment for more than one metric ton of concentrated depleted uranium. Require the Department of Energy to accept perpetual management of a federal cell (if approved) for disposal of concentrated depleted uranium, title to the land on which the federal cell is located, title to the waste in the federal cell, and financial stewardship for the federal cell and waste in the federal cell. Requires notice to a legislative committee. Imposes tax on certain waste. Makes technical and conforming changes.

EnergySolutions – Clive 11e.(2) Byproduct Material Very low volume Groundwater Permit The Division is working with the facility to gather data by performing destructive testing of the Cover Test Cell. The Permit amendment is under review. 11e.(2) Byproduct Disposal

EnergySolutions – Clive – LLRW Evaluation of Performance Assessments Depleted Uranium The Division’s contractor submitted their final review and safety evaluation report. The Division is in the process of reviewing it. LLRW DISPOSAL

EnergySolutions – Clive Mixed Waste The Division has been working with EPA Region 8 on revising the Research, Development and Demonstration (RD&D) Permit to resolve the treatment in the cell issue. Mixed Waste Disposal
