New requirements for Agency Contractors in Bulgaria New local law specifics for Bulgaria have been implemented in the Agency Contractor (AC) lite model process in compliance with Bulgarian labor law. All engagement managers of ACs in Bulgaria have been informed and will comply with these new requirements. All suppliers should be aware of the new files in the process. Initial training Initial training to be provided to the AC related to the assignment, which will be managed by AC´s managers.    Job description Managers have to fill “JD template” in order to provide a job description against signature.

New requirements to be followed by Agency Contractor Labor Desk(ACLD) team: End Date The AC draft order currently provides an end date. According to the Bulgarian law, the ACs could be hired either for (i) a replacement until the effective return of an absent employee or (ii) for a completion of a specific project/work. Therefore binding end date of the assignment could not be provided. Going forward, end date should be left blank in the draft order that is sent to manager and suppler. The tenure will be measured through the template that ACLD fills in HPE’ internal SharePoint, where end date is mandatory. Exact place of work When ACLD is creating the AC draft order, exact place of work – i.e. address, building and floor in the HPE Worksite Location to be listed. Probation period Based on the expected duration of the assignment, probation period usually between 3 to 6 months should be mentioned. It should be filled in the new column in the draft order. It should be sent prior to the AC engagement and is to be done once. ACLD will contact the manger directly to get more details that may not be contained in the job posting, as probation period.

Next requirements to be followed by Engagement Managers Track the AC working hours Fill “attendance form” template to track the AC working hours and to notify the supplier (per email) and the AC (against signature). Send this template on a monthly basis to the supplier. The respective timelines are to be aligned with the suppliers. Specify the basic and additional remunerations, including overtime and night work rates Under the Bulgarian law, HPE needs to specify the basic and additional remunerations, including overtime and night work rates. Notify the vendor per email and the AC(against signature) each month about the respective remuneration elements. Fill ‘income report’ template on a monthly basis and send it to the supplier and AC. Note: ACLD would not be involved in this process. Hard copies of attendance forms and income reports shall remain with the engagement manager.
