WATER QUALITY DIVISION Regulates authority over discharges of pollutants to surface water and land application Implements Water Quality Standards Provides 401 Certification for U.S. Army Corps of Engineers’ dredge and fill permits The mission of the Water Quality Division is to protect water quality in Texas by issuing protective permits, listening to stakeholder input, considering economic development, and using good science. In 1998, TCEQ received delegation authority from the U.S. EPA to issue Texas Pollutant Discharge Elimination System (TPDES) permits to manage wastewater. TCEQ closely monitors federal and state legislation, rules, and policies to ensure we are implementing criteria and developing procedures and assigning limits that are protective of water quality.
Wastewater Permits Texas Pollutant Discharge Elimination System (TPDES) Permits Issued to facilities that discharge directly to surface water. Texas Land Application Permit (TLAP) Issued to facilities that discharge adjacent to surface water via evaporation or land application. Pie chart – Stormwater permits account for approximately 90% of the TPDES permits Pie chart – Municipal wastewater accounts for approximately 65% of the TLAP permits
Wastewater Permits Individual Authorizations General Permits Site-specific and technical review of the regulated activity General Permits One state-wide permit for similar types of activities; operate under terms and conditions of the general permit Pie chart for individual permits- Municipal wastewater permits account for approximately 65% of the permits and Industrial wastewater permits account for approximately 15%. Pie chart - General permit authorizations account for approximately 90% of the permits and authorizations issued by the Water Quality Division.

NPDES Updates Rule EPA finalized specific revisions to clarify and update the permit application Industrial Classification Codes – Requires both SIC and NAICS codes on applications Revised definition of pesticide and pesticide residue Provides flexibility for web-based public notices Rule effective on June 12, 2019 Implementation deadline by June 2020
MS4 Phase II General Permit Municipal Separate Storm Sewer System (MS4) Phase II General Permit Commission adopted the general permit renewal on January 24, 2019. Currently in the renewal period Renewal period ends July 24, 2019 Statewide Workshops
John Graves General Permit TXG500000 Renewal of John Graves General Permit Authorizes discharges from certain quarries located in the John Graves Scenic Riverway. Commission adopted the renewal on March 27, 2019 Currently in the renewal period Renewal period ends on June 27, 2019
CAFO General Permit (TXG920000) Renewal of the Concentrated Animal Feeding Operation (CAFO) General Permit Commission Agenda meeting scheduled for re-adoption on June 26, 2019. Renewal period begins July 21, 2019 Renewal period ends January 17, 2020
Chapter 312 Rulemaking Sludge Use, Disposal, and Transportation Rulemaking to clarify existing requirements and remove inconsistencies. Commission Agenda meeting scheduled June 26, 2019 Public comment period will begin in July 2019 Public meeting will be held in July 2019 Comment period will end in August 2019
Rulemaking for Discharge from Marine Desalination Plants TPWD and GLO developed recommended discharge zones in the Gulf of Mexico for marine seawater desalination discharges TCEQ is required to adopt rules for discharge zones by 2020. HB 4116 Relating to voluntary financial assurance program for TPDES permittees Would allow permittees to establish financial assurance and enter into an agreement with interested parties Financial assurance withdraws would be based on non- compliance with agreement

HB 1059 Relating to a biennial report on stormwater infrastructure in the state Would require a study of the installation and use of green stormwater infrastructure statewide 10 member group would be established to conduct the study and develop the biennial report Report the amount of stormwater managed, money invested, and an assessment of the social, economic, and environmental benefits realized by the use of green stormwater infrastructure
