DLAD Proc Notes & TQ Reqs The Defense Logistics Acquisition Directive (DLAD) is undergoing a major rewrite, focusing on removal of duplicative and redundant regulations and unproductive requirements on Industry. Information previously contained in DLAD provisions and clauses may now appear in either Procurement Notes or Technical and Quality Requirements.

DLAD Proc Notes & TQ Reqs Procurement notes contain instructions to offerors/evaluation criteria Appear in applicable uniform contract format (UCF) section of the solicitation or contract along with standard FAR/DFARS/DLAD Clauses. May also appear separate from the FAR/DFARS/DLAD clauses in Section B, as added by the buyer. Identified by appropriate UCF letter followed by three numbers.   Technical and Quality Requirements contain technical, quality, packaging requirements Appear in Section B Procurement Identification Description (PID). Identified by five-digit code, beginning with an I or R.

DLAD Proc Notes & TQ Reqs Proc Notes and Technical/Quality Requirements will be incorporated by reference in solicitations and awards, unless they require fill-in, in which case they will be incorporated in full-text. Incorporated by Reference: “E01 Supplemental First Article Exhibit Disposition – Contractor Maintained (SEP 2016)” Incorporated in Full-Text: “E01 Supplemental First Article Exhibit Disposition – Contractor Maintained (SEP 2016) The first article units will be maintained or returned to the contractor to be used as a manufacturing standard. The contractor shall hold the approved first article units at the production facility until all production quantities have been produced and accepted. In the case of indefinite delivery contracts, the contractor shall hold the first article units until final production run has been approved and accepted on the first delivery order. The unit shall be considered a production guide or manufacturing standard if defects are reported on delivered material or problems are encountered during production. When disposing the units, the contractor shall follow DFARS 252.245-7004(d). ***** “

Commercial Acquisitions DEFENSE LOGISTICS AGENCY AMERICA’S COMBAT LOGISTICS SUPPORT AGENCY Commercial Acquisitions 19 Sept 16 WARFIGHTER FIRST PEOPLE & CULTURE FINANCIAL STEWARDSHIP PROCESS EXCELLENCE STRATEGIC ENGAGEMENT

“Commercial” Definition The term “commercial” is used generically when an item is determined to meet the requirements of one of the FAR 2.101 Definitions. “Commercial item” – Under this definition there are 8 variations of items that qualify as “commercial”. Generally speaking, if an item is not Commercially available off-the-shelf (COTS), then it is “Commercial of a Type”, meaning simply that the item being purchased by the government is similar, as specified per FAR 2.101, to an item sold in the commercial marketplace.

“Commercial” Definition A commercial item may be “Commercial Off the Shelf (COTS)” or “Commercial of a Type” – the difference being that “of a type” items are modified and/or not sold in substantial quantities in the commercial marketplace. Essentially, the further you get away from Part (1) of the definition of commercial item, the less “commercial” the item is. Examples of modifications: added armor, mil-spec finishes, custom alterations to fit military end item

Benefits (they’re mutual!) Determining an item “Commercial” allows for flexibilities in our procedures. It does not necessarily indicate that there are alternative sources of supply in the commercial marketplace from which we could procure this item. This is a common misconception both within our workforce and within industry. Commercial contract terms are fewer and more in line with standard commercial industry practices. Commercial documents are leaner, and the required posting time is shorter.

Benefits (they’re mutual!) Commercial items may be purchased under Simplified Acquisition Procedures (again leaner documentation/posting/terms) up to total contract value of $7m or $13m (certain emergency acquisitions as determined by DoD) CERTIFIED COST AND PRICING DATA IS NOT REQUIRED for commercial items

Commercial Determinations The contracting officer, not the supplier nor product expert, has the individual authority to determine an item meets the FAR definition of “Commercial”. The determination is made based on Market Research, and information received by technical and industry experts, including sources of supply.

Requirements for Determinations Identify the paragraph of the “commercial item” definition that applies. Similar commercially available item comparison as well as any contradictory information. Evidence of actual sale, lease, license, or offer to the general public (INOVICES! “Catalogs” are heavily scrutinized). The type of modification, if any, and a cost comparison.
