DATA CONFIDENTIALITY Legal Framework Law 226/2009 - on the organisation and functioning of official statistics in Romania, AMENDED BY Law 211/2010 ; law.190/2018 – on the protection of individuals regarding the processing of personal data; Regulation (CE) 223/2009 of European parliament and council AMEnDED by regulation (EU)759/2015; Comission regulation 557/2013/ce – regarding access to confidential data for purposes of scientific research and its guidelines for implementation; European statistics code of good practice – for national and community statistics authorities regarding their integrity, independence and responsibility;
Definition & dissemination conditions Confidentiality of statistical data – implies the protection of the data on individuals (physical or legal persons) which are obtained directly from statistical researches or indirectly, from administrative sources or other sources and who involves the prohibition of using those data for other purposes than statistical. Dissemination conditions: A) can be disseminated only aggregate statistical data for 3 or more individuals, if those data do not allow the identification of individual data and if none of them exceeds 80%; B) can be disseminated individual statistical data about a person (physical or legal) with written agreement of the person; C) some individual data of legal persons are not considered confidentialby statistical law – name, address, activity profile, joint stock, turnover, number of employees; D) confidentiality does not extend on individual data of public institutions, which carries out activities of public interest, except those who are protected by law. E) individual statistical anonimysed data may only be accessed for scientific purposes and only after all data protection measures have been taken
