Agency Framework – Prevention and Resolution of Harassment and Violence in the Workplace Presentation to the Labour Management Consultation Committee (LMCC) October 3, 2017

Purpose To highlight relevant applicable directives, policies and legislation regarding Prevention and Resolution of Violence and Harassment in the Workplace. 2

Agency Legal and Policy Framework The Agency is subject to the following instruments: Harassment Violence Labour Relations TBS Policy on Harassment Prevention and Resolution Canada Labour Code, Part II Federal Public Sector Labour Relations and Employment Board Act (FPSLREA) TBS Directive on Harassment Complaint Process Canada Occupational Health and Safety Regulations Part XX Collective Agreements Agency Occurrence of Workplace violence Procedure TBS Handbook on the conduction of administrative investigations into misconduct A recent Federal Court of Appeal Decision found that harassment may constitute workplace violence (2015 FCA 273) This decision has highlighted the interplay between workplace violence and harassment once again Given this, we will explain the differences and provide options to best manage these situations. 3
