Medicaid Home and Community Based Services Settings Regulations Rule creates new requirements for settings in which states may provide HCBS New waivers or state plans must meet requirements to be approved (CFC) Existing programs may transition into compliance after evaluation by the state (1915(c) waivers) Requirements apply to all settings where people receive HCBS, including employment and training settings Further guidance from CMS on implications for non-residential settings pending
