Key Issues emerging from background research on the progressive implementation of transport planning in terms of the National Land Transport Transitional Act (2000) This report was prepared with financial assistance from the European Union Parliamentary Support Programme.

Summary of Key Issues Lack of Funding Lack of Capacity Transport plans Transport Authorities Operations (Rail, Tendered Contracts, etc) Capital infrastructure Lack of Capacity Municipalities Enforcement Statutory bodies Industry (BEE)

Introduction The NDoT Study Methodology Three case-study areas Interviews with stakeholders Outputs Processes Outcomes Three case-study areas

The City of Cape Town Municipality (CCTM) Western Cape 2,487 square kilometres population of more than 3,000,000 New demarcation + 14% CMC was Core City under UTA Rail 443 km, 117 stations 700 busses covering 800 routes (1 interim contract) 6500 minibus taxis.

eThekwini Metropolitan Municipality (EMM) KwaZulu-Natal 2,297 square kilometres population 2,750,000 New demarcation + 68% land + 9% pop. Durban was Core City under UTA Rail 599 km, 110 stations 1500 busses covering 1842 routes (11 tendered, 2 interim contracts) 6000 minibus taxis

Amatole District Municipality (ADM) Eastern Cape 23,675 square kilometres population 1,600,000 Buffalo City population 880,000 East London was Core City under UTA Rail 18 stations Approx. 160 busses (Amatola, 1 interim contract, >38 rudimentary contracts) 3000 minibus taxis (Buffalo City only) ~ 77%

Report Structure Outputs Registration and Operating Licences     Transport Legislation and Planning          Transport Authorities Processes Capacity Integration Outcomes System of Integrated Planning          Regulated Taxi Industry         Restructured the Bus Industry          Integrated Transport System          Improved Service for the Commuter

OUTPUT: Registration & Operating Licences Key Issues Lack of sufficient capacity to monitor and enforce compliance by operators Poor information systems and inaccurate and un-reliable data Slow progress in appointments ito the NLTTA Lack of clarity on permits and operating licences to be issued Licences conferring use or ownership rights Possible corruption Safety of farm workers and rural commuters

OUTPUT: Registration & Operating Licences Operational Recommendations ® NDoT to assist with specifications/regulations Funds to be directed towards enforcement NDot to coordinate (forums, etc) Legislative Recommendations ® Section 31(1) dates for operating licences Rights confered by operating licence Setting of safety standards

OUTPUT: Transport Legislation & Planning Key Issues Lack of sufficient funding to meet ITP needs Inaccurate Data for CPTR Capacity constraints within both the Category B and C municipalities & uncertainty as to PA. Too high planning frequency

OUTPUT: Transport Legislation & Planning Operational Recommendations ® Dedicated funding for ITP needs National capacity building and support programme Legislative Recommendations ® Planning cycle of 3 years

OUTPUT: Transport Authorities Key Issues Lack of a sustainable financial framework & possible unfunded liabilities (Sect 15(1)b discretion) Need for clarification & national consistency Autonomy of TA particularly in metros may lead to fragmentation & competition Lack of capacity in non-metro & secondary cities Possible unfunded mandates under Section 10(13)

OUTPUT: Transport Authorities Operational Recommendations ® Financial framework National capacity building and support programme Legislative Recommendations ® Reconsider the options for external or internal TAs

PROCESS: Capacity Key Issues Lack of capacity - general Lack of capacity at municipal level NLTTA requirements beyond current capacity Capacity linked to former function as Core City Lack of support in non-pilot sites Need for capacity building of Statutory bodies

PROCESS: Integration Key Issues Limited co-operation between stakeholders Limited integration between municipal land use and transport planning – IDPs Poor integration of the different modes results in an inefficient use of funds Poor communication channels between the different spheres of government

OUTCOME: System of integrated planning Key Issues Poor transport links in IDPs Lack of coordination of stakeholders Institutional war Supply rather than demand driven Frequency of plans

OUTCOME: Regulated Taxi industry Key Issues No real integration between the Registrars & OLBs Routes ® Number per OL Economics vs Enforcement Route plans Operating Licences vs. Permits ® Enforcement (OLB) Capacity & support ® = Recommendation

OUTCOME: Restructured Bus Industry Key Issues Stall in tendered contract process Cost & length of Contracts (7 years) ® Deficiencies in Contract monitoring ® Service Provision Outside NLTTA (Cost of Capital) ® Slow BEE ® Communication with operators

OUTCOME: Integrated Transport System Key Issues Rail governance & funding ® ® Modal Integration Negotiated contracts (bus & taxi) Competition for facilities Bus monopolies Security Safety / vandalism

OUTCOME: Improved Public Transport Service Key Issues Non commuter forums Not enough for elderly / people with disabilities No overall improvement ® = Improve funding

Summary of Key Issues Lack of Funding Lack of Capacity Transport plans Transport Authorities Operations (Rail, Tendered Contracts, etc) Capital infrastructure Lack of Capacity Municipalities Enforcement Statutory bodies Industry (BEE)
