PRIA Local 906 Chapter eRecording-History What makes eRecording legal? The legal foundation lies in three key pieces of federal legislation Federal Electronic Signatures in Global & National Commerce Act (E-SIGN) – Signed June 30, 2000 Uniform Electronic Transactions Act (UETA) – adopted by the ULC in 1999 – adopted by 47 states, the USVI, Puerto Rico, and DC The Uniform Real Property Electronic Recording Act (URPERA), promulgated by the ULC in 2004 and adopted by 28 states, the USVI, and DC The first eRecording was processed in 1999, 20 years ago, in Lancaster County PA (Recorder of Deeds) E-SIGN and UETA provide for the legal equivalency of electronic records and electronic signatures with their paper and wet-ink counterparts. E-SIGN and UETA are “overlay statutes,” which means their provisions were intended to work synergistically with all existing legislation. New legislation did not need to be drafted for every area of each statute that mentioned paper or ink signatures. Existing and future legislation could rely on the E-SIGN and UETA provisions for moving into electronic processes.

Getting started with eRecording What do Registers need to do? PRIA Local 906 Chapter Getting started with eRecording What do Registers need to do? Execute Memorandums of Understand (MOU) contracts with eRecording vendors Work with multiple eRecording vendors Accept fees via ACH Accept real-estate related instruments via eRecording Work with existing LRMS vendor in partnership with eRecording vendors for testing and acceptance Registers work with each eRecording vendor, not each individual submitter Do not limit who eRecorded documents come to you – these companies are delivery mechanisms, much like the postal service, fedex, ups, etc are delivery services for paper documents Accept monies via ACH – each vendor will deposit daily into a designated acct all fees processed through their respective services – Determine documents to be accepted electronically – refer to your state statute Refer to the Best Practice document on PRIA’s site for Recorders/Registers Contact your system vendor for setup, testing, and acceptance before “go live”

Have access to a PC, high-speed internet using a current web browser, and a document scanner Have a MOU on file with an eRecording vendor of your choosing Setup terms with said vendor for payment of recording fees and charges for their respective services (typically through ACH on a daily basis) Begin eRecording Review the major submitters- refer back to previous slide Technical needs – minimal In reviewing vendors, you may determine if any of the primary companies integrate with your current LOS system or title production system to save steps or clicks on the submission side – think about where you record documents in selecting a vendor – check if those counties work with the vendor you wish to work with
