Telecom Regulatory Policy CRTC In order for the Commission to evaluate a complaint regarding an ITMP applied to retail Internet services, the complainant should provide evidence and rationale as to why the ITMP does not meet the requirements of the ITMP framework. The Commission notes that the burden of establishing that an ITMP discriminates or results in a preference or disadvantage is on the complainant. However, pursuant to subsection 27(4) of the Act, the burden of establishing that any such discrimination, preference, or disadvantage is not unjust, undue, or unreasonable is on the primary ISP whose ITMP is under review. Accordingly, the primary ISP will be expected to demonstrate, in its response to the complaint, why its ITMP meets the requirements of the framework.
