Confidentiality and Legislation The boring little things that you REALLY need to know about! …

CONFIDENTIALITY “UK Data Protection Act 1998 makes new provisions for the regulation of the processing of information relating to individuals, including the obtaining, holding, use or disclosure of such information. The European Union Data Protection Directive (EUDPD) requires that all EU members must adopt national regulations to standardize the protection of data privacy for citizens throughout the EU”. You have a responsibility to your clients, staff and your business to maintain data and information safely. Information to consider under the Salons Policy: Name Address Contact details (including address) Salary details Record cards Personal information Information that relates on the business

CONFIDENTIALITY Anyone holding personal data for other purposes than domestic use is legally obliged to comply with The Data Protection Act, it gives rights for those who have their data stored and also gives responsibilities to those who store and process such information. The person WHO HAS their data processed has the right to… View the data an organisation holds on them, for a small fee, known as 'subject access fee' Request that incorrect information be corrected. If the company ignores the request, a court can order the data to be corrected or destroyed, and in some cases compensation can be awarded. Require that data is not used in any way that may potentially cause damage or distress. Require that their data is not used for direct marketing.

CONFIDENTIALITY Anyone holding personal data for other purposes than domestic use is legally obliged to comply with The Data Protection Act, it gives rights for those who have their data stored and also gives responsibilities to those who store and process such information. The person PROCESSING the Information MUST make sure the personal information is… Fairly and lawfully processed Processed for limited purposes Accurate Adequate, relevant and not excessive Not kept for longer than necessary Processed in line with their rights In a secure place Not transferred to third parties, to other countries without adequate protection.

LEGISLATIONS You have a responsibility to be honest and clearly explain to clients the features and benefits of a service or product, being misleading just to get a quick sale is not professional and disloyal.  A Feature means; what the product or service does, e.g. A restructurant conditioner used for dry hair contains moisturises, which penetrate into the cortex, helps strengthen the hair and closes the cuticle  A Benefit is; what the product or service does e.g. Its quick and easy to use, helps to detangle the hair and leaves it looking shiny and healthy. I wonder… I love it!

THE SALES OF GOODS ACT (1979) AND SALE AND SUPPLY OF GOODS ACT (1994) These legal acts are put in place for the consumer to obtain redress if a purchase goes wrong (e.g. if an item of clothing has a faulty zip). What you sell must fit its description, be fit for purpose and be of satisfactory quality. If not, as the supplier you are obliged to sort out the problem! These Acts require the vendor must ensure; ‘Conform to contract’ ‘Satisfactory quality’ ‘Fit for purpose’ I asked for A TRIM!
