Security of tenure for the ageing population in Western Australia Does current housing legislation in Western Australia support Seniors’ on-going housing needs?

The proposal The research will assess the adequacy of the legal framework regulating housing and accommodation in Western Australia as it relates to Seniors.

Why Seniors? Isn’t security of tenure important to everybody?

The regulation What types of accommodation are utilised by Seniors in Western Australia? What State and Commonwealth legislation regulates each type of accommodation? What are the objectives and the ‘mechanics’ of the legislation? Is security of tenure a consideration? If so, to what extent does the legislation safeguard security of tenure?

The realities... This is where seniors, carers, agencies and other stakeholders come in. The legislation may say one thing but what is really happening? What shortcomings have you perceived? If security of tenure is a desired outcome, how is the legislation ‘failing to deliver’?

Research methodology Literature review Collation and examination of relevant law and legislation and other legal materials Consultation Participation in relevant conferences and forums Analysis of findings Interim report Final report

End result 1. A resource comprising all State and Commonwealth legislation relevant to Senior’s housing choices; 2. A catalogue of case studies highlighting problems experienced by Seniors with respect to security of tenure; 3. An assessment of the effectiveness of the legislative scheme in addressing these problems; 4. Where deficiencies are identified, propose workable solutions. To this end other law and legislation relevant to Seniors’ accommodation arrangements in other Australian and selected overseas jurisdictions will be considered; 5. Practical recommendations for a more cohesive legislative scheme and for law reform.
