The Compost Rule Process Why the rule revision? What happens next? 3

The Framework Concept: Minn. R Compost Facilities Yard WasteSolid Waste Source Separated Organic Material (proposed) Subp. 1. ScopeSubp. 4. Design requirements Subp. 8. Design requirements Subp. 2 NotificationSubp. 5. Operation requirements Subp. 9. Operation requirements Subp. 3 Operation Requirements Subp. 6. Compost classification Subp. 10. similar to Subp. 6 Subp. 7. Compost distribution & end use Supb. 11. similar to Subp. 7 4

Ideas Source Separated Organic Material (SSOM) must be source separated at the generator, not pulled from Mixed Municipal Solid Waste (MMSW) at a transfer station Goal is not to develop overly prescriptive standards, but outcome based ones where possible Portions of Demonstration Agreement (Buburl is most current version) will be used for rule Guidance documents on some of the details (technical standards) 5

Ideas Stringency of requirements might need to reflect how broadly the materials are that a facility can accept: – If take everything in statute, need to be more protective – If just yard waste and food waste, then can be less protective Stormwater management requirements are carried forward from existing rules Industrial Stormwater permit required only if a discharge occurs, not if manage on site – If purchasing feedstock materials, will trigger permitting requirement 6

Ideas Currently, there is no standard requirement for Financial Assurance (FA), MPCA wants to reserve right to require FA based on site circumstances Will continue with 503 standards Not intended that animal manure will be part of feedstock College backyard compost sites (Program Management Decision) – Have been taking animal waste 7

Subp. 1. Scope Modify scope to indicate owner or operator of a facility used to compost SSOM( ________________) must comply with the new rule track. Feedstocks – Untreated woods can be used as a carbon source – No demolition debris (sheet rock, insulation, etc.) – What about manufactured wood? 8

Subp. X. Location Standards – Not on Karst – 5’ separation to water table – Flood plain? ? Same as with composting. – No Buffer 9

Subp. 8. Design Requirements Size – ______Large (more requirements) – ______Small (less requirements) Type – Windrows (aearated) – Static Piles (non-aerated) 10

Subp. 8. Design Requirements Pad – Impermeable pad required only under certain circumstances – All weather work surface required (accessible for all seasons for turning) 11

Subp. 8. Design Requirements Pad – Soil infiltration necessary and verified every 5?- 10? years with soil boring – Curing pad (may not)/(will not) need impermeable surface (in reference to using soil as a form of leachate management) 12

Subp. 9. Operation Requirements Immediate mixing of food waste with bulking agent by the end of the day – If not immediate, then place a biofilter on it Odor Management Plan required Sampling and Analysis plan 13

Subp. 9. Operation Requirements Windrows (aearated)Static Piles (non-aearated) Mechanically aearated (blow air) Must be turned at least three times after the compost pile has met the PFRP requirements After PFRP has been reached no new material may be added O2 requirements Biofilter used for VOC and odor control. Usually only “-12” for first few weeks (metro or nonmetro) Maximum height of 12’ (includes biofilter layer) or 10’ (no biofilter layer) 14

Subp. 9. Operation Requirements Training with ceu’s required over a certain size – Need training only if over a certain size – Add as a permit requirement? – Rule language or Guidance? Page 4, item l – Use as needed Odor Management Plan item Page 5, item r – Nitrogen to Carbon Ratios 15

Subp. 10. Compost Classification Readily available testing (bucket method & log of testing) Acceptable testing methods for finished product Maturity testing – Solvita STA requirements – set methods? page 4,item g test methods okay (Demonstration Agreement) 16

Subp. 11. Compost distribution & end use Stay with plan language since most will produce a Class 1 compost 17
