 Written into state law  No justification (survey) needed to enforce w/ radar  State maximum for different roadway designs  55: Max on 2-lane, undivided roads  65: Max on multi-lane, divided and undivided roads  70: Max on certain rural freeways in California 22349(a/b) and 22356(b) CVC

 Anything lower than the state maximums require justification  CHP cannot use radar to enforce PF speed limits without justification  Justification is county Engineering and Traffic Survey (ETS) CVC

 85 th percentile  85% of vehicles driving this road go this speed or lower  Speed limit is set to nearest 5 MPH increment below 85 th percentile speed  Anything lower is a speed trap  CHP must still articulate in court why speed was unsafe for conditions

 CHP cannot enforce a 25 MPH speed limit on Las Gallinas Ave with no ETS  ETS sets safe speed at 30 MPH  ANY radar enforcement would be a speed trap and illegal  Vehicle at 40? CHP can do nothing about it. Why not keep the 25 MPH on Las Gallinas Ave?

 85% of vehicles safely use Las Gallinas Ave at this speed already  Limit would still be 25 at Miller Creek School while children are present  Vehicle at 40? CHP can cite.
