Contactable Prospective Student-Athletes

Definition of Prospective Student-Athlete Started classes for grade nine; or Has not started classes for grade nine but the institution provides any financial assistance or other benefits not provided to prospective students generally.

Definition of Prospective Student-Athlete Remains a PSA until: Officially registers, enrolls full time and attends classes in any term at a four- year institution’s regular academic year; or Participates in regular squad practice or competition at a four-year collegiate institution. NCAA Bylaw 13.02.9

Definition of Enrolled Student-Athlete Enrollment was solicited by a member of the athletics staff or representative of athletics interest; View toward student’s participation in intercollegiate athletics; or Reports for intercollegiate squad under the jurisdiction of the athletics department. Bylaw 13.02.5

Contactable Prospective Student-Athletes Four -year college PSAs. Need permission to contact if a student-athlete (SA). Do not need permission to contact if never a SA. Two-year college PSA. High school PSA. Bylaw 13.1.1

Hearing Opportunity If permission to contact denied: Must inform SA in writing of hearing opportunity within 14 days of receiving SA’s written request. Must be conducted by entity outside athletics. Must include institution’s policies and procedures. Hearing must be conducted within 30 days of written request for hearing. Bylaw 13.1.1.2.1

Case Study 2012 spring semester four-year college softball PSA makes an unofficial visit to campus. Softball coach has on-campus contact with the PSA. Does the coach need permission to contact?

Case Study Conclusion The institution needs permission to contact a four-year college PSA. Bylaw 13.1.1.2 What if the prospect is not an SA? Do not need permission to contact. Need one-time transfer exception to compete. Bylaws 13.1.1.2 and 14.5.5.3.9

Newly Adopted Legislation

NCAA Division II Proposal No. 2012-11: Contacts In-person, off-campus recruiting contacts permitted beginning June 15 immediately preceding a PSA’s junior year in high school. No limit on number or frequency following the first permissible date.

Proposal No. 2012-11: Contacts Effective: June 15, 2012; for any PSA entering his or her junior year in high school June 15, 2012, and thereafter. Bylaws 13.1.1 and 13.1.6

Proposal No. 2012-12: Telephone Calls Telephone calls permitted beginning June 15 immediately preceding a PSA’s junior year in high school. No limit on number or frequency of telephone calls following the first permissible date.

Proposal No. 2012-12: Telephone Calls Effective: June 15, 2012; for any PSA entering his or her junior year in high school June 15, 2012, and thereafter. Bylaws 13.1.1 and 13.1.3

Proposal No. 2012-13: Electronic Transmissions Athletically related recruiting materials, electronic media and electronically transmitted messages permitted beginning June 15 before a PSA’s junior year in high school. Electronically transmitted messages must be private between sender and recipient.

Proposal No. 2012-13: Electronic Transmissions No limit on number or frequency of recruiting materials, electronic media and electronically transmitted messages. Effective: June 15, 2012; for any PSA entering his or her junior year in high school June 15, 2012, and thereafter. Bylaw 13.4

Noncontroversial Amendment to Proposal No. 2012-13 Intent: Electronically transmitted correspondence may not be sent to a PSA during the conduct of the institution’s contests in that sport. Effective: June 15, 2012; for any PSA entering his or her junior year in high school June 15, 2012, and thereafter.

Case Study Date: May 1, 2012. Coach has asked if it is permissible to begin unlimited contacts, phone calls and texts with a two-year college prospect. Coach explains that it should be permissible because it is after June 15 of the PSA’s junior year in high school. Is this permissible?

Case Study Conclusion It would not be permissible to begin unlimited contacts, phone calls and texts to a two-year college PSA on or before May 1, 2012. Effective date of the proposal is June 15, 2012.

Case Study PSA is enrolled in a high school that has an extended calendar. PSA’s last day of his or her sophomore year is July 1, 2012. When can an institution begin unlimited contact, telephone calls and electronically transmitted media to this PSA?

Case Study Conclusion The institution may begin unlimited contacts, telephone calls and electronically transmitted media June 15, 2012, immediately preceding the PSA’s junior year in high school. For international PSAs, institution would need to determine when the PSA’s junior year occurs.

Monitoring No longer need to monitor number and frequency. Should monitor PSA and permissible date of initial telephone call, contact or electronically transmitted media. Institution needs to monitor recruited status. Document content for historical reference.

Proposal No. I-2012-6 Tryouts-Mandatory Medical Exam Medical exam conducted by physician. Within six months of practice, competition or conditioning during prospects senior year in high school. Accepted by prospects high school for the entire senior year. Bylaw 13.11.2.1(c)

Recent Interpretations

Recruiting Functions Used in the Recruitment of Two-Year and Four-Year College Transfers (March 7, 2012) There is no limit on the number or frequency of in-person off-campus contacts, telephone calls, printed recruiting materials, electronic media and electronic transmissions with two-year college transfers or four-year college transfers for whom the institution has received permission to contact. Bylaws 13.1.6, 13.1.3.1, 13.4.1 and 13.4.2

PSA with No Reasonable Expectation of Participation (April 11, 2011) PSA has no reasonable expectation of participating in intercollegiate athletics. Due to disability or terminal illness.

PSA with No Reasonable Expectation of Participation (April 11, 2011) Bylaw 13 restrictions do not apply. Provided the prospect is not a relative of a prospect being recruited by the institution.

Camp Employment for Children of Institutional Staff Members (April 20, 2011) May not employ children of staff members if: Signed a National Letter of Intent (NLI) , written offer of admissions or financial aid with a different institution. May employ children of staff members if: Has not signed an NLI or written offer of admissions or financial aid. Bylaw 13.12.2.1

Definition of a Recruiting/Scouting Service (April 1, 2011) Individual, organization or entity that is primarily involved in: Providing information about PSAs. May provide information to only paid subscribers. May provide service only available to select groups. May provide information to public free of charge.

Definition of a Recruiting/Scouting Service (April 1, 2011) Does not include: Individual, organization or entity that provides information about PSAs incidental to its primary purpose and is generally available to the public (e.g., media outlet).

Recruiting/Scouting Services

Recruiting/Scouting Services May distribute personal information to institutions (e.g., academic or athletics records). May not have fee paid by the PSA based on placing the PSA in a collegiate institution as a recipient of financial aid. May not act as an intermediary between the PSA and an NCAA institution. Bylaw 12.3.3.1

Recruiting/Scouting Services May not provide verbal information to NCAA coaches. May not provide assistance to NCAA coaches with identifying PSAs. May not provide a discounted subscription rate only to certain PSAs. Bylaws 12.1.2.1.6 and 13.14.3.1

Recruiting/Scouting Services May not be endorsed by an NCAA athletics department staff member. May not provide NCAA coaching staff members with expenses to attend an event for recruiting purposes. Common Violations Related to Official and Unofficial Visits

Unofficial Visits Meals – Bylaw 13.7.2.1.1. Complimentary Admissions. One complimentary meal for PSA in institutional dining facility. May be provided at off-campus dining facility when all institutional facilities are closed. Complimentary Admissions. No special seating – Bylaw 13.7.2.1. No special parking arrangements – Bylaw 13.7.2.1.5.

Official Visits – Academic Requirements Presents a score from a PSAT, an SAT, a PLAN or an ACT test taken on a national testing date; Complete registration with the NCAA Eligibility Center; and Be placed on the institution's Institutional Request List (IRL) with the NCAA Eligibility Center.  Bylaw 13.6.2

Ease of Burden Concepts Campus Visits Concepts for feedback: Eliminate use of terms “official” and “unofficial” visits. Institutions limited to providing one expense-paid visit. Amend first opportunity for an expense-paid visit. June 15 immediately preceding PSA’s junior year in high school. Aligns with permissible dates for contacts, telephone calls and electronic transmissions.

Ease of Burden Concepts Campus Visits Concepts for feedback: Change academic requirements for expense-paid visits. PSA may present either a test score or a current transcript to the institution. PSA must register with NCAA Eligibility Center and be placed on IRL. Accounts for earlier date of official visits and the fact that PSA may not have taken a standardized test.

Ease of Burden Concepts Campus Visits Concepts for feedback: Eliminate 48-hour restriction on length of expense-paid visits. Institution may pay two nights lodging. Elimination of three meals per day limitation on expense-paid visits. Institution may pay actual and necessary costs for meals for PSA and those accompanying PSA.
