Planning and Programmes Gill ProudBev Lambert Technical Specialist Planning Liaison Officer FCRM Asset Investment and PlanningPlanning Liaison Team 6 October 2009

Outline Programme planning for FCRM works Funding and prioritisation Procurement Engagement with Spatial Planning

Environment Agency Powers The EA has permissive powers with regard to flood defence under the Water Resources Act 1991 and the Land Drainage Act 1991 This means that we may act to carry out works, but we are not obliged to. The new Floods and Water Bill will not affect these basic powers.

Flood Risk Management Planning

Making Space for Water - Government Policy Catchment Flood Management Plans Flood Risk Management Plans Solutions

Funding and prioritisation

Funding for Flood Risk Management Main funding – FDGiA – £37.5M capital £16.9M revenue £54.4M total FDGiA Internal Drainage Boards precept £ 1.1M Total Core Funding£55.5M Also - Local Levy (from Local Authorities) £1.15M - Match funding from Yorkshire Forward £0.5M Funding for 2009 – 2010 in Yorkshire Area

Constraints We can only use public money to defend existing property We cannot speculatively provide defences to allow development. Under PPS25 if there is no land at lower risk of flooding on which to build, the developer may provide suitable defences.

Appraisal HM Treasury – ‘Green Book’ Best practice guide to carrying out the appraisal and evaluation of policies and projects funded by central government. Preferred method of evaluation: cost benefit analysis. Defra – Flood and Coastal Defence Project Appraisal Guidance 3 – Economic Appraisal (PAG3) Guidance on the application of the ‘Green Book’ methodology to flood and coastal risk management schemes.

Outcome Measures Purpose of OMs: to align programmes with Government objectives for FCERM allow Operating Authorities to design programmes to deliver the objectives establish consistency of reporting efficiency - the right balance in the programme

Outcome Measures OM1 Economic benefits * OM2 Households at risk * OM3 Deprived households at risk * OM4 Nationally important wildlife sites OM5 UK Biodiversity Action Plan habitats* OM6 Flood warning OM7 Contingency Planning OM8 Inappropriate development OM9 Long term policies and action plans

Prioritising Maintenance Expenditure CONSEQUENCE OF FRMS FAILURE Impact on property and land High density housing, commercial and/or industrial property (LU band A/B) Internationally designated sites HIGHC01HIGHC02HIGHC03HIGHC04 Medium density housing, commercial and/or industrial property (LU band C) Nationally designated sites LOWC05MEDC06MEDC07HIGHC08 Little or no housing, commercial or industrial property (LU band D & others) No designations LOWC09LOWC10LOWC11MEDC12 HIGH Negligible risk to life Good warning (adequate evacuation time) Little warning (limited evacuation time) Little/no warning (no evacuation time) Impact on people Notes (1) The presence of vulnerable groups may increase consequence of failure. (2) Warning time refers to failure of an asset, not flood warning time. HIGH

Procurement

Key National Frameworks ContractAnnual Value Expiry National Contractor Framework (NCF2)£120mApril 2011 National Engineering and Environmental Consultancy Agreement (NEECA2) £50mOct 2011 Strategic Flood Risk Management (SFRM) £17mSept 2012 National Cost Consultants Framework (NCCF2) £3mFeb 2010 Under review National Site Investigation Framework (NSIF2) £2.5mOct 2010

Global principals of the Frameworks Procured using NEC form of Contract Developing collaborative but challenging supplier relationships Early Contractor Involvement (ECI) / integrated teams Encourage supplier interaction e.g. Framework Meetings, joint training initiatives Project Incentivisation - Pain/Gain share Regularly review suppliers performance Driving best practice Health & Safety and Environment Encourage right behaviours with an Issue Resolution Protocol

Engagement with Spatial Planning

Environment Agency and Planning Statutory (and non statutory) Consultee on Spatial Plans, certain applications and Environmental Assessment Advice and evidence Water quality, water resources, air quality, land contamination, waste management, biodiversity and flood risk

National & Regional Planning Infrastructure Planning Committee Statutory consultee for all applications Permitting authority Regional Planning Commenting on Regional Spatial Strategies (& Regional Strategies) and SEA/SA Engage early - informal and formal stages Environmental information for evidence base

Development Plans Key Stakeholder Respond to LDD consultations Provide environmental data for evidence base Encourage development of background evidence documents, eg SFRAs, SWMPs Highlight relevant EA plans/programmes

Local Level Engagement Statutory consultee on applications and pre- development proposals Provide technical advice and information Local Liaison meetings Regular discussion with Officers Training (eg FRSA)
